Decree 370/2025/ND-CP (effective from January 1, 2026) amending and supplementing Article 16 of Decree 150/2025/ND-SR stipulates the framework number of rooms under commune-level People's Committees as follows:
- Based on the industry groups and fields specified in Article 15 of this Decree and the criteria on classification of administrative units, population size, natural area, development level, socio-economic conditions, decentralization and delegation of power between local government levels and specific factors of each type of administrative unit, the Provincial People's Committee decides on the framework of the number and names of professional departments applied at commune-level administrative units under its management, ensuring that they do not exceed an average of 4.5 organizations (including: professional departments and Public Administration Service Centers) per commune-level administrative unit; in Hanoi and Ho Chi Minh City alone, they do not exceed an average of 4.7 organizations (including: professional departments and Public Administration Service Centers) per commune-level administrative unit.
- The decision to establish professional departments is decided by the local government at commune level. In case commune-level administrative units do not establish professional departments, specialized civil servants are arranged to advise and assist the People's Committee at commune level in state management of industries and fields according to regulations.
- The Public Administration Service Center under the Commune-level People's Committee shall implement the Government's regulations.
Previously, Article 16 of Decree 150/2025/ND-SR stipulated the framework number of rooms under the commune-level People's Committee as follows:
- Based on the provisions of Article 15 of Decree 150/2025/ND-SR and state management requirements for industries and fields in localities, commune-level local authorities decide on the establishment of professional departments.
- The Public Administration Service Center under the Commune-level People's Committee shall implement the Government's regulations.
