Article 43 of Decree No. 46/2026/ND-CP detailing the implementation of a number of articles and measures to organize and guide the implementation of the Law on Food Safety (effective from April 16, 2026) stipulates the implementation of traceability for unsafe products as follows:
1. Organizations and individuals producing and trading products must regularly establish and fully store information related to products, raw materials, semi-finished products, production facilities, input material supply facilities, product supply, distribution, and business facilities and customers in cases where customers have purchased that product through contracts, books or other methods throughout the production, processing, preservation, transportation, export, import, and business process to serve traceability, stored in the form of databases and connected to the database system of competent state agencies. Information serving traceability includes:
a) Information on production and business activities of food production and business establishments;
b) Product information including name, image, brand, trademark, code symbol, product serial number, type, quantity, volume, batch number, batch size of the product, expiry date, packaging, additives, applicable standards and regulations, information on raw materials, semi-finished products, inspection certificates, time, location of production, business of the product and other related information;
c) Information about organizations and individuals providing, distributing, and trading products and customers (if any).
2. The Minister of Health, the Minister of Agriculture and Environment, and the Minister of Industry and Trade stipulate the traceability of products for food in the assigned management sector and the application roadmap.
Thus, from April 16, 2026, organizations and individuals producing and trading food must regularly establish and fully store the above information to serve food traceability in necessary cases.
