Clause 1, Article 19 of the 2019 Law on Militia and Self-Defense Forces stipulates the commanding position of the Commune Military Command as follows:
"1. The command positions of the Commune-level Military Command, the Military Command of agencies and organizations include:
a) Commander, Political Commissar;
b) Deputy Commander, Deputy Political Commissar."
Regulations on dismissal of the Commune Militia and Self-Defense Command are stipulated in Clause 2, Article 23 of the Law on Militia and Self-Defense Forces 2019:
"Article 23. Appointment and dismissal of militia and self-defense forces command positions
...
2. The dismissal of the positions of militia and self-defense commander is regulated as follows:
a) Remove the positions of militia and self-defense forces commanders when changing work positions or changing organizations without the current position or no longer meeting the standards and conditions for performing the current position;
b) The competent authority deciding to appoint a position has the right to decide to dismiss that position."
Accordingly, when changing work positions, the dismissal must be carried out according to the above regulations.
From July 1, 2025, the Chairman of the People's Committee at the competent provincial level decides to dismiss the position of Deputy Commander of the Commune-level Military Command. Previously, this authority belonged to the Chairman of the District People's Committee.
