Duties and powers of the People's Committee at the commune level from March 2025

The Lao Dong Newspaper Legal Consulting Office replied:

Article 22 of the Law on Organization of Local Government 2025 (effective from March 1, 2025) stipulates the duties and powers of the People's Committees at the commune level as follows:

1. The People's Committee of the commune performs the following tasks and powers:

a) Develop and submit to the People's Council at the same level for consideration and issuance of a resolution to perform the tasks and powers specified in Points a, b, c, d and h, Clause 1, Article 21 of this Law;

b) Organize the implementation of the Constitution and laws in localities; organize the implementation of resolutions of People's Councils at the same level; ensure conditions on facilities, human resources and other resources to implement the Constitution and laws in the area;

c) Implement state administrative management in the area to ensure unity, smoothness, continuity, effectiveness, efficiency, democracy, rule of law, professionalism, modern governance, cleanliness, publicity, transparency, and service to the people;

d) Issue the Working Regulations of the People's Committees at their level;

d) Issue, abolish, amend or supplement documents issued by itself when found to be no longer suitable or illegal;

e) Performing assigned tasks and powers, delegated authority and other tasks and powers as prescribed by law.

2. The People's Committee of the town performs the tasks and powers specified in Clause 1 of this Article and develops and submits to the People's Council at the same level for consideration and issuance of a resolution to perform the tasks and powers specified in Point a and Point b, Clause 2, Article 21 of this Law.

3. The People's Committee of the ward performs the tasks and powers specified in Points b, c, d, dd and e, Clause 1 of this Article and develops and submits to the People's Council at the same level for consideration and promulgation of a resolution to perform the tasks and powers specified in Points a, b, c, h, Clause 1 and Point b, Clause 2, Article 21 of this Law.

Thus, from March 2025, the People's Committee at the commune level has the duties and powers as prescribed above.
