Authority to resolve leave regimes for officers, soldiers, and defense workers

The Lao Dong Newspaper Legal Consulting Office replied:

Article 12, Circular 56/2025/TT-BQP of the Ministry of National Defense stipulates the authority to resolve leave regimes as follows:

1. The authority to resolve the leave regimes prescribed in Articles 4, 5, 6, 7, 8 and 9 is implemented as follows:

a) Regiment commanders, Political Commissars of regroupes and equivalent or more shall resolve for soldiers, workers and defense officials under their authority;

b) Officers holding positions from the Regiment Commander, Political Commissar of the regiment and equivalent or higher are directly decided by the commander or Political Commissar of the higher level.

2. The authority to resolve retirement leave provisions in Article 10 of this Circular shall comply with the Regulations on leadership of personnel work in the Vietnam People's Army of the Central Military Commission; Circular No. 170/2016/TT-BQP dated October 30, 2016 of the Minister of National Defense stipulating the professional military rank of professional soldiers corresponding to the salary, conferment, promotion, and demolition of military rank in cases of disciplinary reprimand for salary reduction; order, procedures, and decision-making authority for professional soldiers, workers and defense officials, amended and supplemented in Circular No. 12/2021/TT-BQP dated January 28, 2021 of the Minister of National Defense.

Thus, the authority to resolve leave regimes for officers, soldiers, workers, and defense officials is prescribed as above.
