The Lao Dong Newspaper Legal Consulting Office replied:
Clause 4, Article 20, Decree 102/2024/ND-CP stipulates the order and procedures for appraisal and approval of district-level land use planning as follows:
a) The agency with the district land management function completes the district land use planning dossier to report to the district -level People's Committee for submission to the People's Council of the same level before the district -level People's Committee submits to the provincial land management function for appraisal; For localities without district -level People's Councils, the district -level People's Committee submits to the provincial land management function for appraisal;
b) Within no more than 05 working days from the date of receiving a complete dossier for comments, the competent provincial land management agency is responsible for sending the dossier for land use planning to members of the Appraisal Council for comments;
c) Within no more than 15 days from the date of receipt of the dossier for comments, members of the Appraisal Council shall send written comments to the competent provincial land management agency;
d) Within 10 days from the end of the time limit for collecting opinions, the provincial land management function is responsible for organizing the evaluation council meeting and sending notice of the results of the land use planning evaluation to the district -level People's Committee;
d) Within no more than 10 days, the People's Committee at the district level is responsible for receiving and explaining the opinions of the Appraisal Council to complete the land use planning dossier and send it to the competent land management agency at the provincial level;
e) Within no more than 10 days from the date of receiving a complete and valid dossier, the competent land management agency at the provincial level shall submit to the People's Committee of the same level for approval of the district-level land use planning.
Thus, the order and procedures for appraisal and approval of district-level land use planning are prescribed as above.
