According to Point d, Clause 1, Article 20 (amended by Point b, Clause 9, Article 10 of the Law amending 11 Laws on Military and Defense 2025, effective from July 1, 2025), the Assistant to the Commune-level Military Command is a civil servant.
According to Clause 2, Article 5 of Decree 220/2025/ND-CP, which amended and supplemented Clause 1, Article 4 of Decree 72/2020/ND-CP, from August 7, 2025, each commune-level administrative unit will be assigned no more than 1 assistant to the Commune-level Military Command.
At the same time, according to Clause 5, Article 5 of Decree 220/2025/ND-CP amending and supplementing the seniority allowance regime for assistants of the Commune-level Military Command in Article 10 of Decree 72/2020/ND-CP, assistants of the Commune-level Military Command with a working period of 60 months or more are entitled to seniority allowances.
The allowance level is as follows: After 5 years (fully 60 months) of work, seniority allowance is equal to 5% of current salary and position allowance, seniority allowance exceeding the framework (if any) or current monthly allowance; from the 6th year onwards, each year (fully 12 months) is calculated by 1%.
In addition, assistants of the Commune-level Military Command who have worked in other professions and are entitled to seniority allowances will have that time added to the time holding the positions of Commanders of the Commune-level Military Command to calculate seniority allowances.
