Civil servants are allowed to participate in business management to commercialize scientific research results

The Lao Dong Newspaper Legal Consulting Office replied:

Clauses 1, 2, 3, Article 12, Decree 271/2025/ND-CP (effective from October 15, 2025) stipulate the establishment, participation in the establishment of enterprises, participation in capital contributions to enterprises to commercialize the results of scientific research and technology development in Hanoi City, stipulating civil servants participating in the management and operation of enterprises as follows:

1. Based on the approved project to establish or participate in the establishment of a business and the authority to manage civil servants according to the provisions of law, the head of the public facility decides to appoint qualified civil servants to participate in the management and operation of the business.

In case the management official is the head of a public facility, he/she must have the consent of the person directly managing him/her.

2. The decision to send civil servants to participate in managing and operating enterprises clearly stipulates the concurrent or seconded time, working regime, salary, bonus, allowance, rights, obligations, and responsibilities of civil servants for public facilities where they work and for enterprises participating in management and operation in accordance with the approved project.

3. Officials can be assigned to participate in managing and operating enterprises many times at a business.

Thus, civil servants are allowed to participate in managing and operating enterprises to commercialize scientific research results according to the above regulations.
