Considering that the first instance judgment was not objective and did not ensure legitimate rights, Ms. Nguyen Ngoc Anh - mother of the late actor Duc Tien - filed an appeal against the entire first instance judgment in the inheritance dispute of her son's property.
According to the petition submitted to the Ho Chi Minh City People's Court, Ms. Nguyen Ngoc Anh said that the First Instance Trial Council had not fully reviewed the documents and evidence in the case file and there were errors in the application of the law. She requested the appellate court to review the entire content of the case, accept her counter-suit request and reject the lawsuit of Ms. Nguyen Binh Phuong - the late wife of actor Duc Tien.
Previously, on October 28, the Ho Chi Minh City People's Court issued a first-instance verdict, partially accepting the requests of both the plaintiff and the defendant. The trial panel determined that the house in Linh Dong ward (Thu Duc city) was Mr. Duc Tien's private property formed before marriage, while the land plot in Long An province had 40% of the value formed before marriage, the rest was the common property of the couple.
The court also recognized the will made by the late actor Duc Tien as legal, and determined that his mother, wife and children were in the first line of inheritance. The first instance verdict decreated that Ms. Nguyen Ngoc Anh received 2 billion VND, Ms. Nguyen Binh Phuong 3 billion VND and the late actor's child received 1.4 billion VND.
Disagreeing with this decision, Ms. Anh appealed and requested the Court of Appeal to reconsider to ensure her legitimate rights and interests
