The Ministry of Construction proposes to amend many regulations on road fees

The Ministry of Construction has just proposed amending a number of articles related to road fees.

The Ministry of Construction has just issued a document responding to the Ministry of Finance on the implementation of Decree No. 90/2023/ND-CP of the Government regulating the collection rate, collection, payment, exemption, management and use of road use fees for amendment to implement Resolution No. 66/NQCP dated March 26, 2025 on the program to reduce and simplify administrative procedures related to production and business activities in 2025 and 2026.

One of the notable things is that the Ministry of Construction proposed to amend the regulation in Clause 2, Article 7 as follows:

2. For inspection units that collect fees

a) Returning road use fees to cases not subject to fees specified in Clause 2, Article 2 of this Decree.

(Compared with Clause 2, Article 2 of Decree No. 90/2023/ND-CP, it is stipulated as follows: vehicles whose vehicle registration certificates and license plates -PV are confiscated or have their vehicle registration certificates -PV revoked)

b) The road toll collection unit is allowed to reserve one-third of (1.32%) of the actual road toll collection to pay for the following contents:

- cover the cost of organizing the collection according to regulations.

- Transfer to the Vietnam Register three-thirds (3%) of the remaining amount (1.32%) to serve the management of collection and payment of road use fees of the national inspection unit system.

c) The remaining amount (after deducting the amount specified in Point a and Point b of this Clause), the road toll collection organization shall transfer it to the specialized collection account of the Vietnam Register within a maximum period of no more than 03 working days from the toll collection date. The Vietnam Register shall pay the fee to the waiting account for payment of the open budget at the State Treasury within a maximum period of no more than 02 working days from the date of collection and transfer to the specialized account of the Vietnam Register. Interest arising from the balance of the fee collection account of the Vietnam Register must be paid to the state budget".

Explaining this proposal, the Ministry of Construction said that it is proposed to adjust the order of Point a and Point b of this Article to ensure that the deduction of 1.32% for toll collection units is carried out on the "real toll collection".

According to statistics from the Ministry of Construction, after implementing Decree 90/2023 on collection, payment, exemption and management of road use fees, 2024 is the first year that the total revenue from road use fees exceeds the threshold of VND 14,000 billion; this revenue contributes significantly to the growth of annual state budget revenue; is the basis for allocating increased funding for maintenance and repair of the national road transport system.

However, new shortcomings have arisen in the implementation of the Decree. Typically, vehicles that are temporarily collected or detained for 30 days or more, vehicles that have expired for inspection and are not participating in road traffic but are still subject to toll collection. The regulation on fee collection for public passenger transport buses (including school, student, and worker vehicles entitled to subsidy policies like buses) is unreasonable.

Therefore, in the document sent to the Ministry of Finance to comment on amending Decree 90/2023; for cases where cars do not have to pay road use fees, the Ministry of Construction proposed to add cars that have been temporarily collected, temporarily detained and temporarily suspended from continuous circulation for 30 days or more.

The Ministry of Construction explained: "In reality, there have been many cases of vehicles being temporarily confiscated or temporarily detained by authorities because they are exhibits related to smuggling, gambling, traffic accidents... and in this case, the vehicle does not use the road traffic system".

On the other hand, many organizations and individuals reflected that the Decree only stipulates that commercial vehicles for transportation temporarily suspended from continuous circulation for 30 days or more are not subject to road use fees, which does not ensure fairness for all vehicle owners.

The Ministry of Construction also proposed that funeral vehicles, including passenger vehicles accompanied by funeral vehicles, flower trucks, photo carts, etc., be used for free on the road.

Previously, because the decree stipulated that funeral service units were allowed to use roads for free, many funeral service businesses were not considered for exemption from paying road use fees.

In case of returning or offsetting the paid road use fee, the Ministry of Construction wishes to amend as follows: For cars specified in Point c, Clause 2, Article 2 of this Decree, before taking the car for repair, the owner must present a record of the accident scene with confirmation from the police and return the inspection stamp and inspection certificate to the nearest inspection facility, to have a basis for refunding the fee after the car has completed the repair and re-inspection for continued circulation. If the documents mentioned above are damaged or lost when the vehicle is involved in an accident, there must be a police confirmation or insurance related to the handling of the accident.

The Ministry of Construction explained that due to many cases of vehicles being damaged by accidents (including fires), stamps and inspection certificates are completely damaged, so the vehicle owner cannot comply with regulations to receive a refund or compensation for the road use fees paid...
