Voters in An Giang province proposed that the Chau Doc - Can Tho - Soc Trang expressway project, the section passing through An Giang province, be supplemented with items arising from the Km 38 intersection, residential access road, sewers and resettlement area, with a total amount of additional sand arising from about 1.52 million m3.
However, according to the special mechanism on sand resources in Resolution No. 60/2022/QH15 dated June 16, 2022 of the National Assembly on investment policy for the Chau Doc - Can Tho - Soc Trang Expressway Construction Investment Project Phase 1 and Resolution No. 106/2023/QH15 dated November 28, 2023 of the National Assembly on piloting a number of specific policies on investment and construction of road works, there is no priority for these additional construction items.
Voters recommended that the Government consider removing obstacles as well as strengthening decentralization and delegation of authority to approve the Project on using public assets for business purposes, leasing, joint ventures and associations to increase proactiveness, ensure unblocking and effective use of public assets for socio-economic development in the coming time.
Regarding this issue, the Ministry of Construction responded as follows:
Regarding the source of sand materials for items arising under the Chau Doc - Can Tho - Soc Trang Expressway Construction Project:
At the 3rd Session and the 6th Session, the 15th National Assembly passed Resolution No. 60/2022/QH15 dated June 16, 2022 deciding on the investment policy for the Chau Doc - Can Tho - Soc Trang Expressway Construction Investment Project Phase 1 (Project) and Resolution No. 106/2023/QH15 dated November 28, 2023 piloting a number of specific policies on investment and construction of road works.
According to the policy approved by the National Assembly, the Project is allowed to apply specific mechanisms and policies on mineral exploitation for common construction materials.
According to calculations, the Chau Doc - Can Tho - Soc Trang Expressway Project through An Giang province (Component Project 1) needs to use about 9.3 million m3 of sand to build the roadbed.
To date, sufficient supply sources have been identified and procedures have been completed, qualified to exploit 9.3/9.3 million m3. For items arising during the implementation process (such as intersections at Km38, residential access roads, sewers and resettlement areas) within the Project scope, a special mechanism for exploiting minerals for common construction materials is applied according to the provisions of Clause 1, Article 4 of Resolution No. 106/2023/QH15: The contractor during the effective period of this Resolution does not have to carry out procedures for granting a Certificate of Exploitation of Minerals for Construction materials as usual in the Construction Materials Survey dossier for 21 projects in Appendix IV attached to this Resolution.
The exploitation of minerals specified in this clause shall be carried out until the project is completed. In case there is no need to establish an investment project for mineral exploitation, it is not necessary to carry out procedures for preparing an environmental impact assessment report".
Regarding the authority to approve the Project on the use of public assets:
Implementing the Party's policies and the National Assembly's requirements on promoting decentralization and delegation of authority; to facilitate and promote local proactiveness in the use of public assets, effectively serving socio-economic development, the Government issued Decree No. 127/2025/ND-CP dated June 11, 2025 regulating the decentralization of state management authority in the field of management and use of public assets.
The provisions of Decree No. 127/2025/ND-CP have completely decentralized the tasks between state agencies at the central level and local governments and promoted the proactiveness, creativity, and self-responsibility of local governments in performing state management tasks in the field of management and use of public assets.
The Chairman of the Provincial People's Committee has the authority to approve the Project on exploiting public assets under the management of the locality to ensure effective use of public assets to serve the socio-economic development of the locality.
