Article 5 of Decree 213/2025/ND-CP clearly stipulates the cost of converting the purpose of using defense works and military zones for socio-economic development and to serve the needs of the people.
Article 5. Cost of changing the purpose of using defense works and military zones for socio-economic development and serving the needs of the people
1. For defense works and military zones that are no longer in need of use, the receiving agency or organization is responsible for paying legal costs directly related to the handover and receipt of defense works and military zones according to the provisions of law on management and use of public assets and land law.
2. For defense works and military zones, the Ministry of National Defense still needs to use
a) Conversion of the purpose of use of defense works and military areas associated with the recovery of defense land, compensation and support shall be implemented in accordance with the provisions of Clause 4, Article 12 of the Law on Management and Protection of Defense Works and Military Zones;
b) Funding for the construction of new works with a minimum scale and area equivalent to old works that have been converted to use or demolished (in case the national defense works are required to be demolished to ensure State secrets);
c) Compensation and support costs for land requiring change of land use purpose and land for construction of national defense works and military zones at new locations shall comply with the provisions of the law on land;
d) Expenses related to the handling of defense works and military zones must be estimated and approved by competent state agencies, including: inventory, measurement; relocation, demolition, cancellation, destruction; valuation and appraisal of property prices; organization of auctions; other related legal expenses according to the provisions of law on management and use of public assets and land law.
3. The cost of changing the purpose of using defense works, military areas, and demolishing defense works shall be paid into the temporary detention account at the State Treasury according to the regulations of the Ministry of National Defense to build defense works and establish military areas at new locations.
