Although there are clear regulations on the process of handling violations of traffic order and safety, many people still do not understand and are worried about driving on the road, afraid of being "unjustly fined".
Below are details of the procedure for handling violations of road traffic order and safety through professional equipment.
Accordingly, the handling of violations of road traffic order and safety is currently being carried out by the Traffic Police according to the instructions in Circular No. 73/2024/TT-BCA of the Ministry of Public Security.
Article 15 of the Circular clearly stipulates the detection of administrative violations through professional technical means and equipment, including:
Traffic police officers use vehicles and technical equipment to detect and collect violations of people and vehicles participating in road traffic.
The driver of a vehicle participating in traffic is responsible for cooperating according to the request for inspection and control through the vehicle and professional technical equipment of the traffic police officer.
The results collected by professional technical equipment and means are photos, images, printed forms, measurement indexes, and data stored in the memory of professional technical equipment and means; are compiled, made a list, printed into photos or records of violations and stored in the administrative violation case file.
When professional technical equipment and vehicles detect and collect information and images of violations of the law by people and vehicles participating in road traffic, the competent person shall organize forces to stop the vehicle to control and handle the violation.
In case the violator requests to see the information, images, and results collected about the violation, the Traffic Police Team will show them at the control location.
If there is no information, image, or result at the control location, the violator is instructed to view the information, image, and result when coming to handle the violation at the unit's headquarters.
Regarding fines through the surveillance camera system, as in Hanoi, the Hanoi Traffic Police Department is currently focusing on handling traffic violations through 600 surveillance camera clusters at key intersections and intersections.
This camera system works well in bad weather conditions and at night thanks to being equipped with a modern infrared lighting system.
These 600 camera clusters will operate 24/7 and record violations on the routes. Data will be transmitted directly to the Traffic Command Center (Hanoi Traffic Police Department).
Here, the staff will directly monitor, analyze the image, record the characteristics, license plate, and violation.
The information was then forwarded to the traffic police teams on duty on the route.
When receiving information about the violating vehicle, the working groups deployed forces to stop the vehicle for inspection and made a record of administrative violations (direct fines - PV).
In case the violating vehicle cannot be stopped for control and handling, a fine will be imposed.
Accordingly, the Traffic Police will verify the identity of the organization or individual involved in the vehicle and the traffic violation through the vehicle registration plate, data from the inspection office and national population data.
After verifying the identity of the organization/individual, in case that individual does not reside in the district-level area where the traffic police agency discovered the violation, the results of the violation collection will be transferred to the competent authority at the commune/district level, where the individual/organization lives and has its headquarters.
After receiving the results of the violation, the police agency and the traffic police of the commune/district with the authority to handle the violation will send a notice of fine to the address of the individual/organization with permanent residence and headquarters in the area.
The sending of violation notices is done in writing, electronically connecting and sharing data on the VNeTraffic App when meeting the conditions on infrastructure, technology, and information.
When receiving a notice of a fine, individuals/organization subject to administrative sanctions for traffic violations must go to the competent police/ Traffic Police to handle and pay the fine according to regulations or prove that they did not violate.
