Voters said that in 2017, in Lac Son district, Hoa Binh province, many households participated in buying and auctioning land use rights organized by the District People's Committee at Pho Ca, Vu Ban town, Lac Son district, Hoa Binh province.
However, currently at Km64, National Highway 12B, the section passing through the residential land of the above households has a separating corrugated iron guard system, with no access to traffic in the area.
Therefore, it causes many inconveniences, seriously affecting the legitimate and legal rights and interests of the people - those who have fully fulfilled their financial obligations when participating in the auction and are granted legal land use rights.
Voters requested the Ministry of Construction to consider and approve the opening of a section of corrugated iron guardrail at Km64, National Highway 12B to build a road for travel, daily life and production for people.
Responding to this issue, the Ministry of Construction said:
According to the provisions of Clause 1, Article 4 of Decree No. 165/2024/ND-CP dated December 26, 2024 of the Government detailing and guiding the implementation of a number of articles of the Road Law and Article 77 of the Law on Road Traffic Order and Safety, National Highway 12B through Hoa Binh province will be decentralized to the People's Committee of Hoa Binh province (UBND) for management, exploitation and use. Currently, the Ministry of Construction has issued a document requesting the Ministry of Finance to transfer assets of road infrastructure in accordance with the provisions of law on management and use of public assets.
Regarding the proposal to open a corrugated iron guard at Km64/QL.12B and build a connection point from residential areas to connect traffic with QL.12B, the Ministry of Construction responded as follows:
Clause 5, Article 27 of Decree No. 165/2024/ND-CP stipulates that localities are responsible for building side roads and service roads to connect regional and local traffic with the main road passing through the area to ensure traffic order and safety and meet the needs of socio-economic development, and ensure national defense and security in the area.
According to the provisions of Clause 5, Article 29 of Decree No. 165/2024/ND-CP, the People's Committee at the provincial level has the authority to decide on the location of connection to the national highway being exploited in the area (except in the case of a national highway).
Therefore, based on the above legal regulations, the Ministry of Construction requested the National Assembly Delegation of Hoa Binh province to give opinions for the People's Committee of Hoa Binh province to consider handling according to its authority the issue of traffic connection and road connection in the province, ensuring that the connection complies with legal regulations, not affecting traffic safety and the road's ability to operate.
