May I ask, in January 2026, I am old enough to receive a pension, but if I want to receive social insurance at one time, will I be able to receive it immediately or will I have to wait a year without participating in social insurance?
While waiting to receive one-time social insurance, can I register for unemployment insurance? ".
Regarding this issue, Dong Thap Provincial Social Insurance responded as follows:
Regarding one-time social insurance payment
According to the provisions of Point d, Clause 1, Article 70 of the Law on Social Insurance 2024 and Decree No. 158/2025/ND-CP dated August 25, 2025 of the Government, employees who have paid social insurance before July 1, 2025, after 12 months are not subject to compulsory social insurance but also do not participate in voluntary social insurance and have paid social insurance for less than 20 years, will receive one-time social insurance.
Clause 2, Article 14 of Decree No. 158/2025/ND-CP stipulates that in case an employee is eligible for one-time social insurance (under 20 years) as prescribed in Point d, Clause 1, Article 70 of the Social Insurance Law 2024, and is eligible for retirement benefits according to Article 64 of the Social Insurance Law 2024, it will be resolved according to the employee's request document.
Compared with the case of Ms. Thuy born in 1969, according to the information she provided, in January 2026, she will be eligible for pension (56 years and 8 months) and if she wants to receive one-time social insurance, she will be selected to receive one-time social insurance according to her proposal. However, in this case, she had to wait 12 months without participating in social insurance to receive it.
Conditions for receiving unemployment insurance
Regarding registration for unemployment insurance benefits while waiting to receive one-time social insurance benefits: According to Article 38 of the 2025 Law on Employment, effective from January 1, 2026, to receive unemployment benefits, employees must fully meet the following conditions:
"a) Resignation of labor contract, employment contract or termination of employment according to the provisions of law without falling into one of the cases where the employee unilaterally terminates the labor contract illegally according to the provisions of the Labor Code or the employee quits work when eligible for pension.
b) Having paid unemployment insurance for 12 months or more within 24 months before the termination of the labor contract, employment contract or termination of employment as prescribed by law.
In case the employee works under a labor contract with a term of 01 month to less than 12 months, he/she must pay for 12 months or more within 36 months before terminating the labor contract.
c) Having submitted a complete application for unemployment benefits within 03 months from the date of termination of the labor contract, employment contract or termination of employment.
d) Within 10 working days from the date of submitting a complete application for unemployment benefits, employees who are not employed and are subject to compulsory social insurance as prescribed in the Law on Social Insurance or perform military service, military service, membership in the People's Public Security, regular militia or study for more than 12 months or comply with the decision to apply the measure of being sent to compulsory education institutions, compulsory drug rehabilitation facilities or being detained, serving a prison sentence or settling abroad or dying".
Compare the case of Ms. T. By January 2026, she is eligible for pension but has not paid enough social insurance (14 years and 9 months) to receive pension benefits.
Therefore, Ms. T was registered for unemployment insurance while waiting for one-time social insurance settlement at her request.
