Answering questions about preferential allowances for teachers

Reader N.T. T. L asked, do teachers who do not have enough teaching hours due to enrollment difficulties receive full professional preferential allowances?

This reader said that he is working at a college that is a public non-business unit directly under the Provincial People's Committee.

In the process of implementing Decree No. 182/2026/ND-CP dated May 22, 2026 of the Government on the regime of professional preferential allowances for teachers, educational institution managers and educational support personnel working in public educational institutions, problems have arisen.

According to reports, in recent years, enrollment work has faced many difficulties, the number of students has decreased, and the size of classes is small, leading to many teachers having actual teaching hours that do not meet the prescribed norms. There are cases where teaching only reaches 20% or 30% of the norm, even not participating in teaching for the whole semester.

Readers request the Ministry of Education and Training to guide these teachers to fully enjoy the monthly professional preferential allowance regime according to the provisions of Decree No. 182/2026/ND-CP or not?

The Department of Teachers and Educational Administrators (Ministry of Education and Training) said that the professional preferential allowance regime for teachers is implemented according to the provisions of Decree No. 182/2026/ND-CP dated May 22, 2026 of the Government.

Accordingly, the subjects entitled to professional preferential allowances are teachers working in public educational institutions under the national education system according to regulations.

Regarding the working regime of teachers teaching in public vocational education institutions, implementation is according to Circular No. 05/2026/TT-BGDDT dated February 12, 2026 of the Ministry of Education and Training.

The Circular stipulates standard hours, the conversion of professional and nghiệp vụ activities into standard hours, and assigns heads of vocational education institutions to issue specific regulations on working regimes, in which the minimum standard hours that must be directly taught are determined, and the conversion of other professional and nghiệp vụ tasks into standard hours.

For teachers who do not hold management positions and are arranged to teach but do not meet the standard hourly quota due to objective reasons such as failure to enroll students, reduced class size, they are still subject to the calculation of professional preferential allowances according to the provisions of Decree No. 182/2026/ND-CP.

However, the head of the vocational education institution is responsible for arranging and assigning teachers to perform other professional and nghiệp vụ tasks and converting these tasks into standard hours according to the provisions of Circular No. 05/2026/TT-BGDĐT to ensure that teachers fully implement the working regime as prescribed.

This reader also asked further, are faculty leaders and deputy faculty leaders who do not teach enough standards entitled to professional preferential allowances?

Regarding this issue, the Department of Teachers and Educational Administrators said that for teachers holding the positions of faculty head and deputy faculty head, if teaching is sufficiently qualified according to the provisions of law, they are entitled to the regime and policies of teachers according to Clause 2, Article 21 of the Law on Teachers No. 73/2025/QH15.

Therefore, in case teachers holding the position of faculty head or deputy faculty head do not perform teaching with sufficient standard hours as prescribed in Circular No. 05/2026/TT-BGDĐT, they are not subject to the calculation of professional preferential allowance regimes as prescribed in Decree No. 182/2026/ND-CP of the Government.
