Unlicensed construction, violating forest land use
Violations of construction order and land in Thach That district, Hanoi continue to have complicated developments. Incidents that caused public outrage such as encroachment, destruction of public land, illegal house construction, etc. or as before are the blatant construction of a series of mini apartments.
Violations continue because they have not been handled thoroughly. Typically, in Tien Xuan commune, more than 4 months after the authorities drew up a record and issued a decision to sanction, the violating construction has not been dismantled.
On December 3, 2024, the People's Committee of Thach That district issued a decision to fine Ms. Vu Thi Minh Thu (born in 1979) for the act of: Organizing construction without a construction permit but according to regulations must have a construction permit for the construction of individual houses.
Scale of violations: Install 5 stilt houses with wooden column frames. The total area of the construction is 187m2, at plot number 111, map sheet number 24-d, village 6, Tien Xuan commune (according to the 2014 survey map, Tien Xuan commune is part of plot number 85, map sheet number 4 and part of plot number 01 of map sheet number 60).
According to the above decision, Ms. Thu was fined 35 million VND. At the same time, within 30 days from the date of issuance of the decision to sanction administrative violations, Ms. Vu Thi Minh Thu must complete the dossier to request the competent authority to issue a construction permit and have a construction permit.
"After this deadline, if Ms. Vu Thi Minh Thu cannot present a construction permit, she will be notified and required to demolish the illegal construction works" - the penalty decision clearly states.
On January 7, 2025, because Ms. Thu could not present a construction permit as prescribed, the People's Committee of Thach That district continued to issue a notice on the implementation of measures to self-dismantle works that violate construction order.
On February 5, 2025, a decision was issued to enforce the demolition of the illegal construction. Tien Xuan Commune People's Committee will preside over and coordinate with the District Urban Construction Order Management Team, the District Department of Natural Resources and Environment, the District Urban Management Department and other relevant agencies to organize the implementation of this decision.
According to the reporter's investigation, on November 26, 2024, the People's Committee of Tien Xuan commune also made a record of administrative violations in the field of land against Ms. Vu Thi Minh Thu, for the act of: Using special-use forest land, protective forest land, and production forest land to other types of land without permission from a competent state agency.
The locality will enforce if the violating household does not dismantle it themselves
Despite a series of documents from the authorities, as of mid-April, according to Lao Dong reporters, in Thach That district, which has been fined for illegal construction, many wooden column-frame houses still exist.
Mr. Nguyen Minh Tan (character's name has been changed) - a local resident said that these works have been there for a long time and have not seen any signs of demolition or enforcement.
According to the reporter's records, near the projects that were fined by the authorities, there were also signs stating that this was a resort named "Rose Valley".
On April 21, speaking with Lao Dong reporter about this issue, Mr. Nguyen Van Nghia - Vice Chairman of Tien Xuan Commune People's Committee said: "The locality has organized a conference to invite Ms. Thu's family to come up, mobilize propaganda, including the front, and departments according to regulations. The family also committed to dismantling it themselves. But I was recently sick.
Meanwhile, Mr. Nguyen Giap Dan - Captain of the Urban Construction Order Management Team of Thach That district said that he is still " urging very actively" to handle these projects.
"We worked with the commune, requesting a record to handle immediately, urgently, in accordance with the law. The processing process, we have advised the District People's Committee to decide to dismantle. They do not dismantle themselves, they will have to develop enforcement plans.
Regarding this issue, on April 22, Chairman of the Hanoi People's Committee Tran Sy Thanh issued a telegram requesting the Chairmen of the People's Committees of districts, towns and cities to take full responsibility for land management and construction order in the area; not to let loose management, creating conditions for violations to arise;
Organize propaganda and mobilize people not to arbitrarily encroach on land or illegally build; promptly detect and thoroughly handle violations from the beginning; Strengthen coordination with relevant departments and branches to resolve complicated cases that go beyond their authority, not to prolong or cause public outrage.
