Information from the People's Committee of Son Tinh district said that on February 25, the district will enforce land recovery for Mr. Huynh Ngoc Khanh (representative of the heirs of Ms. Nguyen Thi Lien's household), belonging to plot No. 49, with an area of over 1,000m2, residing in Tinh Ha commune, to hand over to the construction unit of Tra Khuc 3 bridge.
The Tra Khuc 3 bridge project has a total length of 2.55km, of which the bridge is more than 708m long and the approach road is more than 1.8km long. Of which, the central budget is 525 billion VND, the rest is the provincial budget, the implementation period is from 2022 to 2025. The construction progress of the Tra Khuc 3 bridge project has reached about 90%.
The Khuc tea bridge project has been implemented for many years but until now, Mr. Huynh Ngoc Khanh has not yet handed over the land because Mr. Khanh used to have a house on the land plot. Mr. Khanh's mother lived here. In 1999, the house was damaged by a storm. Since then, Mr. Khanh's mother has moved to live with her children. The land plot is then planted with trees.
When implementing compensation, the competent authority applies Decree 43, so it should be determined that this plot of land has more than 1,000m2 of residential land. Therefore, Mr. Khanh was compensated 1.6 billion VND and 3 resettlement plots. Mr. Khanh has received enough compensation but has not yet received resettlement land.
After that, Son Tinh district realized that there were errors in compensation. After consulting with many specialized agencies, Son Tinh district decided to adjust the compensation plan.
The new plan identifies Mr. Khanh's land plot as having only 200m2 of residential land, in accordance with the land use right certificate. Therefore, the compensation Mr. Khanh received was reduced to 430 million VND and 1 resettlement plot. After adjusting the plan, Son Tinh district requested Mr. Khanh to return the excess compensation. However, Mr. Khanh did not agree with the new compensation plan, did not return the money and did not sign the land handover minutes.
According to Mr. Truong Cong Hoa - Vice Chairman of Son Tinh District People's Committee, the authorities have worked with Mr. Khanh many times to mobilize the return of money and hand over the land. However, Mr. Khanh still did not agree.
Most recently, on February 17, 2025, the Land Acquisition Enforcement Board organized a working session to mobilize, persuade and dialogue with Mr. Huynh Ngoc Khanh to request compliance with the refund of the compensation, support and resettlement amount received and hand over the site for project construction. At the meeting, members of the Land Acquisition Enforcement Board clearly explained the legal basis related to land acquisition, compensation, support and resettlement policies; at the same time, clearly stated the importance of the project to the development of transport infrastructure, promoting local socio-economic development.
The meeting also analyzed the rights and losses of Mr. Khanh's family when the State enforced land recovery. The government's viewpoint is to mobilize families to agree, comply with the decision to reclaim land, hand over the site to ensure the progress of the project; at the same time, guide citizens to exercise the right to file a lawsuit to the People's Court to ensure the legitimate rights and interests of citizens. However, after the working session, Mr. Huynh Ngoc Khanh still did not agree to hand over the site to implement the project...
