Violations lasting for decades
As Lao Dong Newspaper has reported on the situation of a series of illegal construction projects encroaching on the Lo River in Tuyen Quang province, causing the flow to be constricted, seriously affecting flood drainage and being identified as one of the factors causing prolonged flooding.
It is worth mentioning that these violations have existed for a long time and functional agencies have repeatedly requested dismantling and restoring the original state, but most of the encroaching works still linger, causing the Lo River to be narrowed by dozens of meters, the flow to be constricted, reducing flood drainage capacity.
It is known that the handling of existing violations against Dong Tung Gas Trading and Service Production Co., Ltd. (Dong Tung Gas Company), Hung Phung Concrete and Construction Joint Stock Company (Hung Phung Concrete Company) in Vi Xuyen commune and Quy Linh Urban Investment and Development Joint Stock Company in Ha Giang 1 ward are currently being assigned by the People's Committee of Tuyen Quang province to localities for implementation.
However, up to now, 2 encroaching projects with large areas, serious violations of Dong Tung Gas Company and Hung Phung Concrete Company have not been completely resolved, while violations have been detected and administratively sanctioned since 2018.
Talking to Lao Dong Newspaper reporters, Mr. Ly Xuan Tien - Vice Chairman of Vi Xuyen Commune People's Committee said that the locality has inspected and zoned the encroached land area at Dong Tung Gas Company to have a plan to recover and hand it over to the province for handling.
The illegally encroached factory area of Dong Tung Gas Company has an area of more than 400m2. Up to now, this unit has dismantled about 200m2, the rest is related to the machinery system operating in production, so it cannot be dismantled yet.
Dong Tung Gas Company proposed to postpone the dismantling until the adjacent premises are leased to carry out the relocation of factories, machinery and equipment," Mr. Tien said.
Also according to the Vice Chairman of Vi Xuyen Commune People's Committee, the encroached area of Dong Tung Gas Company was formed and lasted for decades. After this unit bought back the factory and continued to build on the encroached land area.
However, overcoming violations is the responsibility of Dong Tung Gas Company. The locality's point of view is to resolutely handle and dismantle encroaching and violating works," Mr. Tien affirmed.
Regarding the violations of Hung Phung Concrete Company, Vice Chairman of Vi Xuyen Commune People's Committee said that the handling and restoration of the encroached area to its original state is facing many difficulties and requires more time due to the verification of the origin of the land used by this unit.
According to Mr. Ly Xuan Tien, Hung Phung Concrete Company's mixing station was built on land purchased from people, which was originally residential land and planting land but was not allowed to change the purpose of use according to regulations. Previously, this area had landfills encroaching on the Lo River.
After Hung Phung Concrete Company built a concrete mixing station and went into operation, the discharge and encroachment continued to be carried out by the unit. We have made overall measurements, determined that the encroached area is about nearly 3,000m2 and have recovered it.
With the land area that the company leased and bought from people to build the project being continuously verified, it has now worked with land owners. However, the responsibility for overcoming violations and restoring the original state belongs to Hung Phung Concrete Company because they are the tenants and buyers of land from people," Mr. Ly Xuan Tien said.
Loosening land management and construction order
According to documents obtained, at the end of 2024, the People's Committee of Vi Xuyen district (old) issued decisions to revoke and abolish a series of documents issued not under the authority of the People's Committee and People's Council of Vi Xuyen district, the People's Committee of Dao Duc commune (now Vi Xuyen commune) issued to Dong Tung Gas Company and Hung Phung Concrete Company, including approving the investment and construction policy beyond authority, and issuing construction permits beyond authority.
Previously, in 2018, the inspection team of Ha Giang province (old) also pointed out the irresponsibility in land management, construction order management, lax state land management to allow land encroachment to build factories and illegal embankment construction, and failure to resolutely handle and definitively lead to violations of Vi Xuyen District People's Committee (old) and Dao Duc commune (old).
Faced with the serious consequences of prolonged flooding from the end of September to the beginning of October 2025 causing Ha Giang 1 ward, Ha Giang 2 ward and some localities along the Lo River, Tuyen Quang Provincial People's Committee has resolutely requested to thoroughly handle violating and encroaching works, and restore the flow to the Lo River. This is assigned to the Department of Agriculture and Environment to preside over and coordinate with relevant agencies.
On December 31, in an exchange with PV, Mr. Do Tat Ky - Deputy Head of the Land Management Sub-Department (Department of Agriculture and Rural Development of Tuyen Quang province) said that currently the unit has not received complete reports from localities on the handling of violating works.
We are continuing to monitor and urge communes and wards to handle and request to send specific reports. After receiving a report from the locality, the working group will summarize, propose and develop a plan to inspect. The viewpoint is to resolutely and thoroughly handle the violations of encroachment on the Lo River that have been pointed out," Mr. Do Tat Ky said.
