Deploying electronic labor contracts, businesses have more opportunities to synchronize data

Some businesses are interested in digitizing labor contracts, especially the ability to connect data with salary, insurance, and financial accounting systems.

Decree No. 337/2025/ND-CP and Circular No. 08/TT-BNV of the Ministry of Home Affairs clarify the legal value of electronic labor contracts, the conditions of participating entities and the service system for conclusion.

According to Ms. Nguyen Thuy Linh - Head of Labor Policy Department, Department of Salary and Social Insurance (Ministry of Home Affairs), the outstanding new point of Decree No. 337/2025/ND-CP and Circular No. 08/TT-BNV is to determine that electronic labor contracts have legal value, ensuring compliance with the provisions of labor law and electronic transactions.

The new regulations also clarify the conditions of subjects participating in concluding electronic labor contracts, including employers, employees and electronic labor contract providers. In particular, specific regulations on the conditions and functions of the electronic labor contract conclusion service system (eContract) are to ensure the legal validity of the contract.

Another noteworthy content is the clear regulation of the position and role of the Electronic Labor Contract Platform.

In addition, the new regulations define the rights and responsibilities of relevant agencies, organizations, and individuals in concluding electronic labor contracts as well as building and operating the Electronic Labor Contract Platform.

From a business perspective, Ms. Nguyen Thi Tuyet - Deputy Director of the Business Solutions Center, MISA Group - said that businesses are paying great attention to this issue.

According to Ms. Tuyet, MISA has organized many webinars and seminars and attracted about 5,000-6,000 interested businesses at each seminar. However, depending on the scale and type, businesses have different interests.

When there are new regulations in Decree No. 337/2025/ND-CP, the concern of the group of medium and large enterprises is more focused on the implementation method and the ability to interlink data with existing management systems.

Businesses are concerned about whether data is linked to their current management systems, such as salary systems, insurance or finance, accounting" - Ms. Tuyet said.

Meanwhile, for smaller businesses, the issue of much concern is the requirement to comply with the law.

Businesses raised many questions about the legality of electronic labor contracts, the value of evidence when labor disputes occur, or whether it is necessary to re-sign contracts signed before July.

Despite different concerns, business groups pay attention to the employee's experience when implementing electronic labor contracts. Businesses want to know whether new systems, tools, processes and regulations will help employees easily implement them.

If a process, regulation or tool requires too many technological skills, too complex, it will be very difficult to deploy on a large scale" - Ms. Tuyet assessed.

According to her, with new requirements and practical concerns from businesses, new policies can help businesses easily access and better implement in the digital transformation process.
