On November 9, according to Lao Dong's source, the People's Committee of Lang Son province issued Decision 86/2025/QD-UBND stipulating the order and procedures for short-term land lease by land fund development organizations assigned to manage.
This decision takes effect from November 18, 2025.
Accordingly, land fund leased for a short term is the land area that has been allocated to a land fund development organization for management during the period when the State has not yet decided to allocate or lease to the user according to the plan.
The tenants are organizations and individuals who have a need to use land temporarily, meet the conditions of civil behavior capacity, fire prevention and fighting safety, environment and are not in cases of financial obligations or violations of land laws.
The lease is carried out according to the principles of publicity, transparency, and objectivity, to ensure fairness between parties and avoid loss of public assets.
Land fund development organizations are responsible for preparing a list of land for lease, determining the starting price, then publicly announcing it on the electronic information portal of the province and commune within 30 days to receive the registration documents
The person who is allowed to lease the land is the organization or individual proposing the highest price but not lower than the starting price. In case there are many documents at the same price, priority is given to people with adjacent plots of land, suitable use purposes and environmental factors.
When selected, the tenant will sign a contract according to the agreed form, pay land rent and a deposit equivalent to 20% of the contract value to ensure the responsibility for dismantling the temporary construction when the lease term expires
The rent is paid annually, stable during the lease term. Rents can request a maximum extension of 5 years, with rental prices adjusted according to the consumer price index (CPI).
The Provincial People's Committee assigned the Land Fund Development Center to preside over and coordinate with departments, branches and commune-level authorities to periodically inspect land use, handle cases of improper use, late payment of rent or illegal sub-lease
The new regulation is expected to help improve the efficiency of exploiting temporary public land funds, creating conditions for businesses and business households to access production facilities, while increasing transparency in the management and use of public assets in Lang Son province.
