The Ministry of Agriculture and Environment received a petition from voters of Bac Giang province (now Bac Ninh province) sent by the Central Committee of the Vietnam Fatherland Front in Report No. 75/BC-MTTQVN with the content "The situation of overloaded soil transport vehicles causing environmental pollution in some localities still occurs".
Regarding this proposal, the Ministry of Agriculture and Environment said that the law on environmental protection has regulations on environmental protection in transportation activities with regulations and sanctions for vehicles that pollute the environment.
Clause 2, Article 65 of the Law on Environmental Protection stipulates that "vehicles transporting raw materials, materials, and waste must be covered, not allowed to splash, causing environmental pollution when participating in traffic".
Article 25 of Decree No. 45/2022/ND-CP of the Government on administrative sanctions for violations in the field of environmental protection (Decree No. 45/2022/ND-CP) stipulates violations of regulations on environmental protection in public places, urban areas, and residential areas; transportation of raw materials, materials, and goods that cause environmental pollution.
Accordingly, Clauses 3 and 4 have stipulated: Fines from VND 2,000,000 to VND 4,000,000 for the act of transporting raw materials, materials that do not cover or let them fall into the environment while participating in traffic;
Fines from VND 10,000,000 to VND 15,000,000 for failure to use specialized equipment and means during the transportation of materials and goods that cause leakage and dissemination to the environment".
The Ministry of Agriculture and Environment added that the Ministry is currently completing to submit to the Government for consideration and promulgation a Decree amending and supplementing a number of articles of Decree No. 45/2022/ND-CP mentioned above in the direction of aggravating the act of transporting raw materials and materials without covering or letting them fall into the environment while participating in traffic, with fines ranging from 4,000,000 VND to 8,000,000 VND.
During the process of implementing inspection and examination responsibilities in the area, it is recommended that local authorities, based on the violation situation, take timely measures to prevent and handle it, ensuring the strictness of the law - the Ministry of Agriculture and Environment emphasized.
Recently, Lao Dong Newspaper has also published articles reflecting on the situation of vehicles carrying soil and sand causing environmental pollution in some localities such as Hanoi and Cao Bang.
