The Ministry of Public Security is sending documents to the Ministry of Justice for review of the Decree on administrative sanctions for violations of traffic order and safety in the field of road traffic; deduction of points, restoration of driving license points.
In this draft, the Ministry of Public Security proposed to keep the current fines for violating the lowest alcohol concentration threshold for motorbike and specialized motorbike drivers without reducing them as in the previous draft.
In the section on summarizing, explaining, and receiving comments from agencies, organizations, and individuals on the draft Decree, many units commented on the regulation on alcohol concentration.
In which, the People's Committee of Hoa Binh province commented (with the previous draft): Increase the fine for the act of "Driving a vehicle on the road with alcohol concentration in blood or breath but not exceeding 50 milligrams/100 milliliters of blood or not exceeding 0.25 milligrams/1 liter of breath" to ensure deterrence.
The People's Committee of Nghe An province commented as follows: Regarding the act of "Driving a vehicle on the road with a blood or breath alcohol concentration exceeding 50 milligrams to 80 milligrams/100 milliliters of blood or exceeding 0.25 milligrams to 0.4 milligrams/1 liter of breath", the draft Decree stipulates that points will be deducted from the driver's license, but the right to use the driver's license will not be revoked.
"Violation of alcohol concentration is one of the causes of traffic accidents, so it is necessary to continue to handle this behavior more drastically to increase deterrence; it is recommended to study and re-regulate the form of punishment for the above behavior to suit the current situation" - Nghe An Provincial People's Committee explained.
Responding to the proposal of the People's Committee of Hoa Binh and Nghe An provinces, the Ministry of Public Security said it had accepted and revised the content on alcohol concentration violations in this draft Decree.
In the third draft of the Ministry of Public Security, the alcohol concentration violation thresholds continue to be determined as per current regulations.
Accordingly, the lowest level is not exceeding 50mg/100ml of blood or 0.25mg/liter of breath; exceeding 50mg to 80mg/100ml of blood or exceeding 0.25mg to 0.4mg/liter of breath; the highest level is exceeding 80mg/100ml of blood or exceeding 0.4mg/liter of breath.
Notably, in the latest published draft, the Ministry of Public Security withdrew the proposal to lower the fine level compared to Decree No. 100/2019 (amended and supplemented in Decree 123/2021) for violations of alcohol concentration not exceeding 50mg/100ml of blood or not exceeding 0.25mg/1 liter of breath.
Accordingly, the Ministry of Public Security proposed a fine of 6 to 8 million VND for drivers of cars and similar vehicles, four-wheeled motorized passenger vehicles, and four-wheeled motorized cargo vehicles whose blood or breath alcohol concentration does not exceed 50 mg/100 ml of blood, or does not exceed 0.25 mg/1 liter of breath. At the same time, 3 points will be deducted from the driver's license.
This level is similar to the provisions in Decree 100 (amended and supplemented in Decree 123) currently in force.
The draft of the Ministry of Public Security is still being reviewed by the Ministry of Justice and has not been submitted to the competent authority for approval.
