Civil liability insurance for motor vehicles (compulsory motorbike insurance) is always of concern to people. Reader Le Cam Van asked: As far as I know, the Law on Insurance Business will abolish some regulations from July 1. So, will the law remove the regulation on compulsory motorbike insurance or not?
Answering this question, lawyer Nguyen Thu Trang, Deputy Director of Heva Co., Ltd. said that the Law amending and supplementing a number of articles of the Law on Insurance Business (Law No. 139/2025/QH15) was passed by the 15th National Assembly on December 10, 2025.
This Law takes effect from January 1, 2026, except for the cases specified in Clause 2 of this Article.
Clause 2 stipulates: Clause 6 and Clause 8, Article 2 of the Law take effect from July 1, 2026. Accordingly, from July 1, 2026, Article 143 and Article 155 of the Law on Insurance Business are abolished.
In comparison with regulations, 2 clauses in the Law on Insurance Business are abolished as follows:
Article 143 on conditions for providing insurance support services and Article 155 amending and supplementing Appendix IV of Investment Law No. 61/2020/QH14 have been amended and supplemented with a number of articles according to Law No. 03/2022/QH15 (on insurance brokerage and insurance support services).
Lawyer Nguyen Thu Trang added that the regulations on compulsory motorbike insurance (civil liability insurance for motor vehicles) in the Law on Insurance Business are stipulated in Article 8 as follows:
1. Compulsory insurance is an insurance product aimed at protecting public interests, the environment and social safety.
2. Compulsory insurance includes:
a) Compulsory civil liability insurance for motor vehicle owners;
b) Compulsory fire and explosion insurance;
c) Compulsory insurance in construction investment activities;
d) Compulsory insurance specified in another law that meets the provisions of Clause 1 of this Article.
3. Organizations and individuals subject to compulsory insurance are obliged to purchase compulsory insurance and are allowed to choose to participate in compulsory insurance at insurance companies and branches of foreign non-life insurance companies licensed to deploy.
4. Insurance enterprises and branches of foreign non-life insurance enterprises licensed to deploy compulsory insurance must not refuse to sell when organizations and individuals meet the conditions to purchase compulsory insurance according to the provisions of law.
5. The Government shall specify the insurance conditions, insurance premium rates, and minimum insurance amount for compulsory insurance specified in Clause 2 of this Article.
Thus, according to regulations from July 1, some regulations in the Law on Insurance Business will be abolished (mainly related to insurance brokerage and insurance support services). However, compulsory motorbike insurance stipulated in Article 8 is not amended or abolished. Accordingly, people need to comply with this provision of the law.
