On the Government Information Portal, Mr. N.D.T in Tay Ninh reflected that he has a car. The car space is not enough to carry more luggage, he wants to attach a roof/roof rack to carry luggage.
Mr. T said that, according to his research, Article 6 of Circular No. 43/2023/TT-BGTVT stipulates that roof socket installation does not require design documents, but there are no implementation instructions.
Mr. T contacted some registration centers and was told that if installed, registration will be refused. He asked if this is true, and he asked to be guided on how to resolve it?
The Vietnam Register answers this question as follows:
From January 1, 2025, regulations on motor vehicle renovation will be implemented according to Circular No. 47/2024/TT-BGTVT (replacing Circular No. 85/2014/TT-BGTVT and amended and supplemented circulars such as Circular No. 43/2023/TT-BGTVT that Mr. Nguyen Duc Thang has learned about).
Based on the regulations in this circular, Mr. N.D.T's case is resolved as follows:
Regarding the refusal of registration that Mr. T reflected: According to the provisions of Clause 1, Article 11 of Circular No. 47/2024/TT-BGTVT, the registration facility is responsible for checking and comparing the actual vehicle with the registration documents.
In case the vehicle has an additional roof/top panel but has not been granted a certificate of renovation, it means that the vehicle has a deviation from the information in the registration certificate. Therefore, the registration agency's refusal to carry out inspection is completely in accordance with regulations to ensure technical safety and legal compliance.
Solutions to install roof racks in accordance with regulations: Installing roof racks for cars is identified as a vehicle renovation act. To create favorable conditions for people and businesses, Circular No. 47/2024/TT-BGTVT has classified this case as a simple renovation with simplified regulations:
Regarding design: According to point d, clause 5, Article 20 of Circular No. 47/2024/TT-BGTVT, vehicle owners are exempted from preparing a renovation design dossier if the installation complies with the manufacturer's instructions and does not change the entire width of the vehicle.
Regarding procedures: Despite being exempted from design, vehicle owners are still required to carry out renovation certification procedures according to the provisions of Article 21 and Article 23 of Circular No. 47/2024/TT-BGTVT.
To complete the procedures and be inspected, vehicle owners follow the following steps sequentially:
Step 1: Due to being exempt from design documents, car owners only need to prepare:
Document requesting certificate of renovation (according to the form in Appendix XVII of Circular No. 47/2024/TT-BGTVT).
Present vehicle registration documents: original vehicle registration certificate, or certified copy/electronic copy certified, or original vehicle registration certificate issuance appointment.
Step 2: The vehicle owner brings the vehicle and the prepared dossier to any registration facility.
Step 3: Registration facility conducts actual inspection and evaluation on the same day after receiving sufficient valid dossiers.
If the requirements are met, the registration agency will issue a certificate of renovation and at the same time issue an inspection certificate and inspection stamp for the vehicle.
after being granted a certificate of renovation, vehicle owners must carry out procedures to renew the registration certificate for further inspection.
