Reader Nguyen Quy An - who is a technology motorbike taxi driver in Hanoi - said: "Our work often involves using Google Maps. Currently, this software has a voice guidance function. When wearing headphones, even without using our eyes to see, we can still hear instructions. However, as far as I know, wearing headphones when riding a motorbike will be heavily fined. I hope that functional agencies can consider amending this regulation.
On the Ministry of Public Security's Information Portal, reader P.S.T reflected that recently, in cyberspace, some opinions have appeared that the regulations on penalizing the act of using headphones when participating in traffic are outdated, no longer suitable for the current technological development conditions and need to be considered and adjusted.
Therefore, readers request the Ministry of Public Security to provide information on the legal basis, the practical basis (potential risk of traffic accidents when using headphones while participating in traffic), the necessity, and the forms of penalties for the act of using headphones while participating in traffic?
Regarding this content, the Ministry of Public Security answers as follows:
Point c, Clause 3, Article 33 of the Law on Road Traffic Order and Safety in 2024 stipulates: "Motorcyclists, three-wheeled motorcycles, and motorbikes are not allowed to use sound equipment, except for hearing aids".
Point d, clause 4, Article 7 of Decree No. 168/2024/ND-CP dated December 26, 2024 of the Government stipulating penalties for administrative violations of traffic order and safety in the field of road traffic; deducting points, restoring points of driver's licenses stipulates:
People who are driving motorbikes and motorcycles using sound equipment (except for hearing aids) are fined from 800,000 VND to 1,000,000 VND, and have their driver's license points deducted by 04 points".
Thus, the Law on Road Traffic Order and Safety in 2024 and Decree No. 168/2024/ND-CP stipulate sanctions for the act of using headphones to ensure that vehicle drivers focus on observing and listening to traffic signals and warning sounds from other vehicles, contributing to preventing the risk of traffic accidents and ensuring traffic order and safety.
The Ministry of Public Security acknowledges citizens' feedback and will summarize and study it in the process of reviewing and evaluating the implementation of legal regulations on road traffic order and safety.
