Ben Tre voters reported that recently, the government has banned all types of homemade vehicles from circulating (small trailers carrying grass, coconuts, pigs, agricultural products... gathered on main roads).
The policy of banning homemade vehicles from circulation is in line with modern life, however, in reality, the demand for rickshaws in rural areas is very high. On the other hand, due to the characteristics of the dense network of rivers and rural roads such as in the Mekong Delta, the means of transporting farmers' products from the growing place to the purchasing place are only three-wheeled vehicles and small rickshaws, which are suitable and convenient for people.
Voters recommend considering allowing this type of vehicle to circulate on inter-hamlet and inter-group roads to transport agricultural products to main roads to serve people's lives, and at the same time recommending the state to research, produce and sell alternative means of transport to rudimentary vehicles that meet standards for people to buy and use, both in accordance with legal regulations and ensuring people's needs and livelihoods.
Responding to this issue, the Ministry of Transport said that, regarding the solution to handle agricultural vehicles, 3-wheeled and 4-wheeled homemade vehicles, in Resolution No. 32/2007/NQ-CP dated June 29, 2007 of the Government on a number of urgent solutions to curb traffic accidents and traffic congestion, the Government stipulated: "From January 1, 2008, the circulation of expired automobiles, agricultural vehicles, 3-wheeled and 4-wheeled homemade vehicles will be suspended. In case of intentional violation, the vehicles will be confiscated, sold as scrap, and added to the public fund".
Implementing Resolution No. 32/2007/NQ-CP of the Government, ministries, branches and localities have focused on directing competent agencies to suspend the circulation of agricultural vehicles and homemade three- and four-wheeled vehicles within the time limit prescribed by the Government.
The Prime Minister issued Directive No. 1405/CT-TTg dated September 30, 2008 on continuing to manage agricultural vehicles, three-wheeled motor vehicles, and three- and four-wheeled rudimentary vehicles in accordance with Resolution No. 32/2007/NQ-CP and Resolution No. 05/2008/NQ-CP of the Government. In which, the People's Committees of provinces and centrally run cities were assigned to urgently carry out a number of tasks to implement the restriction of the use of vehicles banned from circulation in accordance with Resolution 32/2007/NQ-CP.
To resolve difficulties for people whose vehicles are subject to suspension of circulation under Resolution No. 32/2007/NQ-CP; the Prime Minister issued Decision No. 1491/QD-TTg and Decision No. 548/QD-TTg.
The Ministry of Finance has issued Circular No. 122/2009/TT-BTC. Thus, in recent times, the Government and ministries, branches and localities have introduced many solutions to support people in converting their vehicles to ensure traffic order and safety, contributing to reducing traffic accidents and congestion, while raising awareness of compliance with laws on traffic order and safety.
Regarding legal regulations, the Law on Road Traffic Order and Safety, effective from January 1, 2025, has provisions on types of road vehicles. Accordingly, Article 34 of the Law stipulates types of motor vehicles, rudimentary vehicles and specialized motorbikes.
On that basis, the Ministry of Transport proposed that the National Assembly Delegation of Ben Tre province coordinate to direct local agencies and units to strengthen the dissemination of the above regulations to the people to organize implementation in accordance with the provisions of the Law to ensure consistency and unity in management and implementation, creating favorable conditions for people and businesses in the area.
Regarding the State's proposal to research, produce and sell alternative means of transport to replace rudimentary vehicles that meet standards for people to buy and use in accordance with legal regulations. The Ministry of Transport would like to acknowledge the content of this proposal and will continue to coordinate with relevant ministries and branches to advise on policies to ensure proper implementation of legal regulations and in accordance with the types of vehicles as prescribed in the Law on Road Traffic Order and Safety.
