The Government has just issued Decree No. 81/2026/ND-CP stipulating penalties for administrative violations in the field of railway traffic, effective from May 15. In this decree, regulations on sanctioning authority are as follows:
Article 41. The sanctioning authority of the Chairmen of People's Committees at all levels
1. The Chairman of the People's Committee at the commune level has the power to:
a) Warning;
b) A fine of up to 37,500,000 VND;
c) Revoke the right to use the license for a limited term or suspend operations for a limited term;
d) Confiscation of exhibits and means of administrative violations;
d) Applying remedial measures specified in Clause 3, Article 3 of this Decree.
2. The Chairman of the Provincial People's Committee has the power to:
a) Warning;
b) A fine of up to 75,000 VND;
c) Revoke the right to use the license for a limited term or suspend operations for a limited term;
d) Confiscation of exhibits and means of administrative violations;
d) Applying remedial measures specified in Clause 3, Article 3 of this Decree.
Article 42. The sanctioning authority of the People's Police
1. People's Police soldiers on duty have the right to:
a) Warning;
b) A fine of up to 7,500,000 VND;
c) Confiscation of exhibits and means of administrative violations with a value not exceeding 02 times the fine level specified in point b of this clause.
2. Heads of mobile police units at the company level have the power to:
a) Warning;
b) A fine of up to 15,000,000 VND;
c) Confiscate exhibits of administrative violations with a value not exceeding 02 times the fine level specified in point b of this clause;
d) Applying remedial measures specified in Clause 3, Article 3 of this Decree.
3. Head of Police Station, Head of Battalion-level Mobile Police Unit, Head of Station, Team Leader has the power to:
a) Warning;
b) A fine of up to 22,500,000 VND;
c) Revoke the right to use the license for a limited term or suspend operations for a limited term;
d) Confiscation of exhibits and means of administrative violations with a value not exceeding 02 times the fine level specified in point b of this clause;
d) Applying remedial measures specified in Clause 3, Article 3 of this Decree.
4. The Head of the Commune-level Police has the power:
a) Warning;
b) A fine of up to 37,500,000 VND;
c) Revoke the right to use the license for a limited term or suspend operations for a limited term;
d) Confiscation of exhibits and means of administrative violations;
d) Applying remedial measures specified in Clause 3, Article 3 of this Decree.
5. Heads of departments guiding and managing conditional investment and business lines on security, order and seals under the Department of Police for Administrative Management of Social Order; Heads of professional departments under the Department of Traffic Police include: Heads of Departments guiding propaganda, investigation, and resolution of traffic accidents; Heads of Departments guiding, registration and inspection of vehicles; Heads of Departments guiding, training, testing, and management of licenses of drivers of vehicles; Heads of Departments guiding patrol and control of road and railway traffic; Heads of Departments guiding traffic control and escort; Heads of Regiment-level Mobile Police units; Heads of professional departments under the Department of Economic Security include: Heads of Departments of Traffic Security, Construction; Heads of Departments of Science, Technology and Natural Resources, Environment; Heads of professional departments under the Department of Fire Prevention, Fighting and Rescue including: Heads of Fire Prevention and Fighting Departments; Heads of Fire Prevention and Fighting and Rescue Departments; Heads of Provincial Police including: Heads of Departments of Police for
a) Warning;
b) A fine of up to 60,000,000 VND;
c) Revoke the right to use the license for a limited term or suspend operations for a limited term;
d) Confiscation of exhibits and means of administrative violations;
d) Applying remedial measures specified in Clause 3, Article 3 of this Decree.
6. Provincial-level Police Directors have the power to:
a) Warning;
b) A fine of up to 75,000 VND;
c) Revoke the right to use the license for a limited term or suspend operations for a limited term;
d) Confiscation of exhibits and means of administrative violations;
d) Applying remedial measures specified in Clause 3, Article 3 of this Decree.
7. Director of the Traffic Police Department, Director of the Police Department for Administrative Management of Social Order, Director of the Economic Security Department, Director of the Fire and Rescue Police Department, Commander of the Mobile Police have the power to:
a) Warning;
b) A fine of up to 75,000 VND;
c) Revoke the right to use the license for a limited term or suspend operations for a limited term;
d) Confiscation of exhibits and means of administrative violations;
d) Applying remedial measures specified in Clause 3, Article 3 of this Decree.
