Proposal to apply a new roadmap for motorbike emissions to be fined after 18 months

The Ministry of Agriculture and Environment is proposing a roadmap for motorbike emission inspection. However, when there is a roadmap, uninspected vehicles will not be immediately fined.

The Ministry of Agriculture and Environment is continuing to collect opinions on the draft (2nd time) roadmap for motorbike emission inspection.

According to the new draft, the roadmap for applying emission standards is as follows:

From July 1, 2027 for Hanoi and Ho Chi Minh City.

From July 1, 2028 for the remaining provinces and centrally-run cities.

From July 1, 2030 for the remaining provinces and cities. Depending on the actual situation, these provinces and cities can regulate the application of the deadline earlier.

In this draft, the Ministry of Agriculture and Environment proposes to stipulate:

Within 18 months from the date of starting the emission inspection of motorbikes and motorbikes participating in traffic, the emission inspection must be carried out. During this time, the authorities have increased propaganda, mobilization, and guidance on the implementation of emission inspection without implementing violation handling activities.

After this deadline, the authorities will organize inspections, supervision, and handling of violations according to regulations.

In the process of implementing the Decision, if difficulties or problems arise, it is recommended that ministries and People's Committees of provinces and centrally run cities promptly report to the Ministry of Agriculture and Environment and the Ministry of Construction for study, reporting, and proposing to the Prime Minister for consideration, amendment, and supplementation accordingly.

Ministers, heads of ministerial-level agencies, heads of government agencies, Chairmen of People's Committees of provinces and centrally run cities, and relevant organizations and individuals are responsible for implementing this Decision.

The penalty for motorbikes that do not have emissions inspection has been previously regulated.

Point b, Clause 1, Article 32 of Decree No. 168/2024/ND-CP stipulates a fine of VND 200,000 to VND 300,000 for individuals and VND 400,000 to VND 600,000 for organizations that are owners of motorbikes and mopeds (motorbikes) that bring vehicles without an emission inspection certificate or have one that has expired or use a motorbike emission inspection certificate not issued by a competent authority.

Point a, Clause 4, Article 40 of Decree No. 168/2024/ND-CP stipulates a fine of VND 16,000,000 to VND 20,000,000 for inspection facilities that violate inspection and granting inspection certificates to motor vehicles and specialized motorbikes, and inspection of motorbike emissions not in accordance with regulations, standards, and technical regulations.
