So, does the regulation on compulsory motorbike insurance change? Currently, what does the dossier for motorbike insurance compensation include?
Lawyer Nguyen Thu Trang, Deputy Director of Heva Co., Ltd., said that the Ministry of Finance is proposing a draft Decree amending and supplementing a number of articles of Decree No. 67/2023/ND-CP stipulating compulsory civil liability insurance for motor vehicle owners, compulsory fire and explosion insurance, and compulsory insurance in construction investment activities. This Decree is expected to take effect from July 1, 2026.
Analyzing the new points of the draft Decree, Lawyer Nguyen Thu Trang said that the draft Decree amending and supplementing a number of articles of Decree No. 67/2023/ND-CP mainly amends regulations on construction activity insurance. The new draft continues to inherit regulations on compulsory motorbike insurance (civil liability insurance for motor vehicles).
Accordingly, people need to note that motorbike insurance continues to be a mandatory type of insurance.
Dossiers to enjoy current motorbike insurance are still implemented according to Decree No. 67/2023/ND-CP.
Accordingly, the dossier for compulsory civil liability insurance compensation of motor vehicle owners includes the following documents:
Compensation request document.
Documents related to motor vehicles, drivers (copies certified from the original or certified copies of the insurance company after comparison with the original or photocopy):
Vehicle registration certificate (or certified copy from the original Vehicle Registration Certificate accompanied by the original Receipt of the credit institution still valid, replacing the original Vehicle Registration Certificate during the time the credit institution keeps the original Vehicle Registration Certificate) or vehicle ownership transfer documents and vehicle origin documents (in case there is no vehicle registration certificate).
Driver's license.
Identity card or citizen identification card or Passport or other personal papers of the driver.
Insurance certificate.
Documents proving damage to health and life (copies of medical facilities or certified copies of insurance companies after comparison with the original or photocopy). Depending on the severity of the loss of life, one or more of the following documents may include:
Injury certificate.
Medical records.
Excerpt from the death certificate or death notice or confirmation document of the police agency or the examination results of the forensic examination agency for cases where the victim died in a vehicle, died in an accident.
Documents proving damage to property:
Invoices, valid documents or evidence proving the repair and replacement of damaged assets caused by accidents (in case the insurance company performs repairs and remedies, the insurance company is responsible for collecting these documents).
Documents, invoices, and documents related to incurred costs that motor vehicle owners have spent to minimize losses or to implement according to the instructions of the insurance company.
Copies of relevant documents of the police agency in fatal accidents involving a third party and passengers or cases where it is necessary to verify that the accident is entirely due to a third party's fault, including: Notice of investigation, verification, and settlement of the accident or Notice of investigation conclusion and settlement of the accident.
Appraisal record of the insurance company or the person authorized by the insurance company.
Court decision (if any).
