Colonel Nguyen Quang Nhat, Head of the Department of Guidance, Propaganda, Investigation, and Resolution of Traffic Accidents - Traffic Police Department (Ministry of Public Security) said that the abolition of Decree 100/2019/ND-CP does not mean stopping handling traffic violations, but is implementing separation and adjustment according to each specialized field.
Recently, the Government issued Decree No. 81/2026/ND-CP (Decree 81) regulating penalties for administrative violations in the field of railway traffic, effective from May 15.
Notably, this Decree abolishes the entire Decree 100/2019/ND-CP, the previous document regulating administrative violations in both road and railway traffic.
Immediately after receiving information about the abolition of the entire Decree 100/2019/ND-CP, many people mistakenly thought that some traffic violations would stop being penalized.
However, to help people better understand the new regulations, Colonel Nguyen Quang Nhat affirmed that the abolition of Decree 100/2019/ND-CP does not mean stopping handling traffic violations, but is implementing separation and adjustment according to each specialized field.
Previously, the Government issued a Decree on road fines. That is Decree 168/2024/ND-CP regulating penalties for administrative violations of road traffic order and safety, and applying the mechanism of deducting points and restoring driver's license points, effective from January 1, 2025. This Decree has amended, supplemented and abolished some contents of Decree 100/2019/ND-CP to be consistent with the new regulation system.
People should note that railway traffic violations under Decree No. 81/2026/ND-CP from May 15 will have higher penalties than the current Decree 100.


In fact, in the past time, traffic police have strengthened the handling of railway violations.
April 2nd, the Traffic Police Department said:
Ninh Binh Provincial Police have made a record of handling driver H.V. H (April 1) for the violation in the area of the level crossing intersecting with the railway (Km 122+550, North - South railway line, Ninh Khanh ward, Ninh Binh city).
Accordingly, driver H.V. H driving the vehicle committed the act of driving the vehicle across the level crossing when there was a warning signal, failing to comply with railway traffic safety regulations, posing a potential risk of particularly serious accidents.
Nationwide, the Traffic Police Department has directed localities with railway lines passing through to continue to simultaneously launch campaigns, tighten management and strictly handle violations of railway traffic safety and order, especially at road-railway intersections with automatic barriers.
Accordingly, traffic police have arranged 80 working groups with 226 officers and soldiers to perform patrol and control tasks.
The results recorded on April 1st showed that 128 violations had been detected and handled, including: 9 cars, 116 motorbikes and 3 bicycles.
Main violations:
Careless overtaking when the red light has been turned on, regardless of the warning signal: 12 cases (when the barrier is not lowered).
When the barrier is lowering: 8 cases
Especially dangerous: 2 cases (when needed, the block was completely lowered).
Stopping vehicles within railway traffic safety boundary: 83 cases.
The Traffic Police Department said that in some hot spots of violations, Ho Chi Minh City leads with 34 cases.
Next is Hanoi, 17 cases and Da Nang 14 cases.
Many other localities such as Khanh Hoa, Hue, Thanh Hoa, Lao Cai, Dong Nai, Lam Dong, Nghe An, Phu Tho, Quang Ngai, Dak Lak, Gia Lai, Hai Phong, Bac Ninh, Ninh Binh, Quang Ninh, Hung Yen, Lang Son, Ha Tinh, Quang Tri also recorded violations.
The Traffic Police Department assessed: Although localities have seriously implemented the direction, the awareness of law compliance of a part of traffic participants is still very limited.
Intentionally violating when the traffic lights are on, even when the barriers have been completely lowered (a total of 22 cases) is an extremely dangerous act, posing a high risk of tragic railway traffic accidents.
Traffic police recommend that railway traffic accidents always leave painful consequences. Raise awareness and strictly comply with regulations when crossing level crossings.
