Government abolishes Decree 100 on handling traffic violations from May 15th

The Government abolished Decree No. 100/2019/ND-CP regulating penalties for administrative violations in the field of road and railway traffic.

This content is stated in Decree No. 81/2026/ND-CP of the Government stipulating penalties for administrative violations in the field of railway traffic.

Decree No. 81/2026/ND-CP consists of 4 chapters, 50 articles regulating administrative violations, completed administrative violations, ongoing administrative violations, forms of sanctions, levels of sanctions, remedial measures for each administrative violation, subjects to be sanctioned, sanctioning authority, specific fines according to each title, authority to make records for administrative violations and the implementation of administrative sanctions in the field of railway traffic.

The Decree stipulates violations in the field of railway traffic including: violations of regulations on signals, railway traffic rules and ensuring railway traffic order and safety; violations of regulations on railway infrastructure; violations of regulations on railway traffic vehicles; violations of regulations on railway business; other violations related to railway traffic.

This Decree takes effect from May 15, 2026; repealing Decree No. 100/2019/ND-CP dated December 30, 2019 of the Government stipulating penalties for administrative violations in the field of road and railway traffic (amended and supplemented by Decree No. 123/2021/ND-CP dated December 28, 2021 of the Government amending and supplementing a number of articles of Decrees stipulating penalties for administrative violations in the field of maritime; road and railway traffic; civil aviation).

According to the Traffic Police Department (Ministry of Public Security), the abolition of Decree 100 does not mean stopping handling traffic violations, but is implementing separation and adjustment according to each specialized field.

Accordingly, Decree 100/2019/ND-CP, along with the contents amended and supplemented in Decree 123/2021/ND-CP, will expire.

This is a decree issued in 2019, detailing violations, forms and levels of penalties, remedial measures, as well as the authority to make records and impose penalties in the field of road and railway traffic.

Previously, the Government issued Decree 168/2024/ND-CP stipulating penalties for administrative violations of road traffic order and safety, and at the same time applying the mechanism of deducting points and restoring driver's license points, effective from January 1, 2025.

This Decree has amended, supplemented and abolished some contents of Decree 100 to be consistent with the new regulation system.

Following that, on December 22, 2025, the Government issued Decree 336/2025/ND-CP regulating penalties for administrative violations in road activities. This Decree continues to adjust regulations related to penalties in the field of road traffic, and at the same time abolishes some penalties in the field of railways.

Thus, after many revisions, supplements and separations according to each management field, Decree 100/2019/ND-CP has been officially abolished entirely according to Decree 81/2026/ND-CP.

According to current regulations, violations of traffic order and safety in the field of roads will be penalized according to specialized decrees on road traffic, including the mechanism for deducting points and restoring driver's license points.

For violations in other state management fields related to road and railway traffic but not specified in these decrees, the handling will be based on the corresponding administrative violation sanctioning decrees of each field.
