Decree 100 to be abolished soon, traffic police strengthen penalties for railway violations

Railway traffic violations currently have many regulations regulated by Decree 100.

According to the Traffic Police Department, on March 30, 2026, the national traffic police force simultaneously strengthened inspections and strictly handled violations at intersections between roads and railways, contributing to reducing the risk of traffic accidents.

Local police in railway routes have detected and handled 127 violations (12 cars, 111 motorbikes, 4 bicycles); of which 121 cases were directly handled, and 6 cases were fined remotely.

The main violations include:

Crossing the level crossing when the red light has been turned on, the barrier has not been lowered: 12 cases; Exceeding when the barrier is lowered: 4 cases; Exceeding when the barrier has been completely lowered: 1 case; Stopping vehicles within railway traffic safety: 86 cases; Other violations: 24 cases.

The results of handling by locality are as follows: Ho Chi Minh City 34 cases; Hanoi 17 cases; Da Nang 13 cases; Hue 10 cases; Khanh Hoa 7 cases; Quang Tri 06 cases; Lao Cai 05 cases; Hai Phong, Nghe An each locality 4 cases; Bac Ninh, Dong Nai, Ha Tinh, Quang Ninh, Quang Ngai each locality 3 cases; Gia Lai, Lang Son, Hung Yen, Thanh Hoa each locality 2 cases; Dak Lak, Ninh Binh each locality 1 case.

In Hanoi alone, functional forces have coordinated to barricade 40 self-opened paths, and at the same time narrow 8 self-opened paths on the Hanoi - Ho Chi Minh City and Bac Hong - Van Dien railway lines; functional forces will continue to deploy on March 31, 2026.

The Traffic Police Department recommends that people strictly comply with traffic lights and barriers at level crossings; do not stop or park within the safe railway area; absolutely do not overtake when there is a warning signal to ensure the safety of life and property.

Regarding handling railway traffic violations, Colonel Nguyen Quang Nhat, Head of the Department of Guidance, Propaganda, Investigation, and Resolution of Traffic Accidents - Traffic Police Department (Ministry of Public Security), the abolition of Decree 100/2019/ND-CP does not mean stopping handling traffic violations, but is implementing separation and adjustment according to each specialized field.

Specifically, recently the Government issued Decree No. 81/2026/ND-CP (Decree 81) regulating penalties for administrative violations in the field of railway traffic, effective from May 15.

Notably, this Decree abolishes the entire Decree 100/2019/ND-CP, the previous document regulating administrative violations in both road and railway traffic.

Immediately after receiving information about the abolition of the entire Decree 100/2019/ND-CP, many people mistakenly thought that some traffic violations would stop being penalized.

However, to help people better understand the new regulations, Colonel Nguyen Quang Nhat affirmed that the abolition of Decree 100/2019/ND-CP does not mean stopping handling traffic violations, but is implementing separation and adjustment according to each specialized field.

Previously, the Government issued Decree 168/2024/ND-CP stipulating penalties for administrative violations of road traffic order and safety, and at the same time applying the mechanism of deducting points and restoring driver's license points, effective from January 1, 2025. This Decree has amended, supplemented and abolished some contents of Decree 100/2019/ND-CP to be consistent with the new regulation system.

On December 22, 2025, the Government issued Decree 336/2025/ND-CP regulating penalties for administrative violations in road activities. This Decree continues to adjust regulations related to penalties in the field of road traffic, and at the same time abolishes some penalties in the field of railways. After many revisions, supplements and separations according to each management field, Decree 100/2019/ND-CP has been officially abolished entirely.

People should note that railway traffic violations under Decree No. 81/2026/ND-CP from May 15 will have higher penalties than the current Decree 100.
