Recently, voters in Khanh Hoa reported that currently in Nha Trang city (a tourist city), the male labor force participating in driving to serve tourists is very large.
However, according to Clause 5, Article 8 of Circular No. 46/2012/TT-BGTVT of the Ministry of Transport on training, testing, and granting of road motor vehicle driving licenses, it is instructed: "Those studying to upgrade their driving license to classes D and E must have a junior high school diploma or equivalent or higher."
The above regulation has affected the upgrading of driving licenses to classes D and E for drivers without a junior high school diploma.
To meet the job needs of the workforce aged 40 to 55 participating in social development, voters request the Ministry of Transport to research, apply, and create conditions to upgrade driver's licenses to serve the large number of tourists coming to Khanh Hoa province.
Responding to this issue, the Ministry of Transport said that according to the provisions of Clause 5, Article 61 of the 2008 Law on Road Traffic, people who need to be trained to upgrade their driving license to class D and class E must have at least a junior high school education.
Accordingly, the system of legal documents stipulates detailed instructions on the law, including instructions on implementation for cases of driving license upgrade exams to ensure the consistency of the system of legal documents.
According to the provisions of the Law on Road Traffic Safety and Order, which will take effect from January 1, 2025; in which, Clause 4, Article 60 stipulates that people who need to upgrade their driving license to class D1, D2, D (equivalent to current class D and class E) must have a junior high school degree or higher.
Therefore, the Ministry of Transport requests voters of Khanh Hoa province to continue to coordinate in implementing the provisions of current laws.
