Circular No. 35/2024/TT-BGTVT regulates training, testing, and granting of driving licenses; issuance and use of international driving licenses; training, testing, and granting of certificates of training in road traffic law knowledge. The Circular takes effect from January 1, 2025.
Article 35 of the Circular stipulates the re-issuance of driving licenses as follows:
Driving license will not be reissued in the following cases:
The driver's license is not in the driver's license information system at the Vietnam Road Administration, the list of driver's license issuance (management book).
Not yet re-issued driving licenses to violators of road traffic order and safety who have not yet completed the request of competent state agencies to resolve and handle administrative violations in the field of road traffic order and safety.
The Circular stipulates that people whose driving licenses are lost and still valid can have their driving licenses reissued.
The date of passing the test printed on the back of the driver's license is calculated from the date of passing the test of the old driver's license.
Driver's license renewal application issued by the Department of Transport includes:
Application for change (re-issuance) of driving license according to prescribed form.
The driver's health certificate issued by a qualified medical examination and treatment facility according to the provisions of law on medical examination and treatment is still valid (except for people with a class A, A1, B1 driving license).
Certified copy or electronic copy of the original or electronic copy issued from the original book of the driving license or Decision on administrative sanction for violations in the field of road traffic in case of revocation of the right to use an integrated driving license.
Valid passport (for foreigners and Vietnamese people residing abroad).
The procedure is as follows:
Individuals prepare a set of documents according to regulations and send them directly or via the online public service system to the Department of Transport.
In case of direct application, individuals must take a photo directly at the driving license issuing agency and must complete the fee payment obligation upon receipt of the application.
In case of submitting documents via the online public service system, individuals must declare according to the instructions, be responsible for the accuracy and legality of the declared content, and must fulfill the obligation to pay the driver's license fee through the payment function of the online public service system as prescribed and pay fees for other services according to the individual's needs. When receiving a driver's license, the old driver's license must be returned for filing.
The Department of Transport checks the records upon receipt, looks up the violation management software of the information system on training, testing, granting of driving licenses, certificates of training in road traffic law knowledge, accesses the database software on road traffic order and safety of the police sector or looks up violations of drivers through electronic identification accounts.
In case the driving license is not eligible for exchange or the application is not in accordance with regulations, the individual must be notified directly or in writing or via the online public service system of the contents that need to be supplemented or modified within 2 working days from the date of receipt of the application.
Within 5 working days from the date of receiving a complete application in accordance with regulations (including authentication of electronic identification accounts via the electronic identification and authentication system), the Department of Transport shall carry out the change of driving license; in case of not changing the driving license, a written response must be given stating the reason.
The driving license issuing agency shall store the original copy of the driving license exchange file issued by the transport sector (except in the case of driving license exchange via the online public service system) for 2 years from the date of issuance of the driving license and collect the old driving license (in the case of online driving license exchange, the driver is responsible for sending the old driving license to the driving license issuing agency for cancellation according to regulations) except in the case of exchanging a driving license for a person with an integrated driving license whose driving license is being revoked.
In case the driver needs to change the driving license to a lower class, he/she must clearly declare in the application for changing (re-issuing) the driving license as prescribed and be responsible for the declared content.
