Citizen N.H.T reflected: "I established a Transport Company Limited, only leasing cargo cranes but not transporting goods, so do I have to apply for a transport business license?".
Regarding this content, the Vietnam Road Administration has the following opinion:
Clause 4 and Clause 11, Article 56 of the Road Law stipulate:
Road transport business is an activity of organizations and individuals (hereinafter referred to as transport business units) using rudimentary vehicles and motor vehicles to provide road transport services for the purpose of making a profit;
Cargo transportation business is a type of transportation business that uses cargo cars and specialized cars to transport goods by road".
Based on the above provisions, in case a Transport Company Limited uses a cargo car or a specialized car to transport goods on the road for profit, it must issue a Transport Business License according to the provisions of Section 4 (Articles 19, 20, Decree No. 158/2024/NDCP dated December 18, 2024 of the Government regulating road transport activities.
