The Government issued Decree No. 153/2025/ND-CP amending and supplementing a number of articles of Decree No. 72/2023/ND-CP dated September 26, 2023 of the Government regulating standards and norms for the use of automobiles. The Decree will take effect from July 1, 2025.
According to the new regulations, the following commune-level positions are allowed to use cars for general work to perform duties and tasks assigned by agencies, organizations, and units (not used for transportation and pick-up from place of residence to agency and vice versa):
Secretary, Chairman of the People's Council, Chairman of the People's Committee, Chairman of the Vietnam Fatherland Front at the commune level; Deputy Secretary, Vice Chairman of the People's Council, Vice Chairman of the People's Committee, Vice Chairman of the Vietnam Fatherland Front Committee at the commune level.
One of the notable amendments is the regulation on allocating (adjusting) the number of cars for general work of agencies, organizations, and units:
Based on the total number of cars serving the general work of agencies, organizations and units prescribed, the competent authority and person deciding to allocate the specific number of cars is as follows:
The Standing Committee of the Provincial Party Committee and the City Party Committee decides to allocate the number of cars for general work to each agency and public service unit under the Provincial Party Committee and the City Party Committee (excluding the Commune Party Committee).
The Provincial People's Committee decides to allocate the number of cars for general work to each Provincial Party Committee Office (except the Provincial Party Committee and City Party Committee Office); each provincial department, branch, and equivalent, the Provincial Vietnam Fatherland Front Committee, each socio-political organization; each public service unit under the Provincial People's Committee; each commune (including the Commune Party Committee).
The allocation is based on the principle that the number of cars allocated to each agency or unit can be higher or lower than the number of cars determined according to the provisions of this Decree, but must ensure that the total number of cars after allocation of all agencies, organizations and units does not exceed the total number of cars determined according to regulations.
In case the agency, organization or unit has a affiliated or affiliated unit with legal status, its own seal or account, the competent authority or person shall decide to allocate the number of vehicles to each affiliated or affiliated unit of the agency, organization or unit when implementing the allocation according to the provisions of this point.
The number of vehicles after being allocated is the norm for the number of cars used for general work of each agency, organization, and unit; used as one of the bases for planning and budget estimates, allocating, purchasing, arranging, and controlling funding for the use and rental of automobile services; managing, using, and handling automobiles at agencies, organizations, and units.
The decision to allocate the number of cars for general work is made public on the Electronic Information Portal of the Central Party Office, the Central Committee of the Vietnam Fatherland Front, ministries, central agencies, provinces and centrally run cities.
