Before the 2024 Social Insurance Law officially takes effect from July 1, 2025, sending a question to Vietnam Social Insurance, reader N.H.X asked: "If foreigners have worked and paid social insurance in Vietnam for 5 years, will foreigners receive a one-time allowance after terminating their labor contracts? If so, what documents are required? ".
Regarding this issue, Vietnam Social Security responds as follows:
According to Point d, Clause 6, Article 9 of Decree No. 143/2018/ND-CP dated October 15, 2018 of the Government detailing the Law on Social Insurance and the Law on Occupational Safety and Hygiene on compulsory social insurance for foreign workers working in Vietnam, it is stipulated that:
Foreign workers working in Vietnam who are subject to compulsory social insurance and have a request are entitled to receive one-time social insurance when their labor contract or labor license, practice certificate, or practice license expire without an extension.
The one-time social insurance application is stipulated in Article 109 of the Law on Social Insurance 2014 including: Social Insurance Book; Application for one-time social insurance (Form No. 14-HSB attached to Decision No. 686/QD-BHXH dated May 29, 2024 of Vietnam Social Insurance).
