Regarding this issue, the Ministry of Health responded as follows:
Clause 4, Article 3 of Decree No. 56/2011/ND-CP dated July 4, 2011 of the Government stipulates:
"4. The 40% allowance applies to civil servants and public employees who regularly and directly practice preventive medicine; testing; medical examination and treatment; infection control, patient care, rehabilitation; medical examination; traditional medicine; pharmaceuticals, cosmetics; food safety and hygiene, medical equipment; reproductive health at public health facilities and at nursing facilities for war invalids, sick soldiers, and people with special disabilities, except for cases specified in Clauses 1, 2, and 3 of this Article".
Clause 1, Article 2 of Joint Circular No. 02/2012/TTLT-BYT-BNV-BTC dated January 19, 2012 of the Ministry of Health, the Ministry of Home Affairs, and the Ministry of Finance stipulates:
"1. Civil servants and public employees regularly and directly work in health care (salary arranged according to civil servant ranks with the first 2 digits of the rank code of 16 or 13. to perform the following tasks:
a) Examination, treatment, care, service for patients and rehabilitation;
b) Testing for medical professional work;
c) Imaging diagnosis, functional exploration, nuclear medicine, radiotherapy;
d) pathological pathology;
d) Prevention and control of infectious diseases, border health quarantine;
e) Prevention of epidemics, social diseases, occupational medicine and environmental sanitation;
g) Infection control, biosafety; household registration, public health;
h) Testing, testing, and appraisal;
i) Mixing, processing, preserving, distributing drugs, vaccines, chemicals, and the environment for cultivation at medical facilities;
k) Research in medicine and pharmacy; direct medical technical expertise;
l) Specialized in food safety and hygiene, controlled nutrition;

n) Conservation, cleaning, care for bodies and morgue;".
Implement the Law on Civil Servants and guiding documents, regulations on ranks and rank codes that have expired after receiving consensus from the Ministry of Home Affairs in Official Dispatch No. 2218/BNV-TL dated May 20, 2016 on the implementation of preferential allowances according to occupation and the Ministry of Finance in Official Dispatch No. 9102/BTC-HCSN dated July 4, 2016 on preferential allowances according to occupation for civil servants and public employees working in public health facilities; the Ministry of Health issued Official Dispatch No. 5845/BYT-TCCB dated July 29, 2016 guiding localities and units to implement preferential allowances according to occupation.
