A representative of Vietnam Railway Corporation emphasized that railways are dangerous areas, and pedestrian encroachment can cause serious accidents. If the violation causes an accident or damages a railway structure, the violator may be prosecuted for civil or criminal liability, depending on the level of damage.
Currently, the railway industry has installed fences, warning signs and propaganda to limit the situation of people illegally encroaching. If discovered, violators will be reminded and punished by authorities such as traffic police or railway staff according to regulations.
According to Article 268 of the 2015 Penal Code (amended and supplemented in 2017), people who obstruct railway traffic and cause damage to others can be fined from VND 30,000,000 to VND 100,000,000, sentenced to non-custodial reform for up to 3 years or imprisoned from 1 year to 3 years.
In addition, according to Clause 1, Article 47 of Decree 100/2019/ND-CP, pedestrians who violate regulations on railway safety may be fined from VND 60,000 to VND 100,000, including the following acts:
Overcome cross-road and bridge barriers when the barriers are moving or have been closed.
crossing the level crossing when the red light is on.
Failure to comply with the commands and instructions of signs, road markings or instructions of level crossing guards, public bridges, and tunnels when crossing level crossings, public bridges, and tunnels.
Some other violations related to ensuring railway traffic safety are stipulated in Clause 1, Article 49 of Decree 100/2019/ND-CP. Accordingly, violators may be fined from VND 300,000 to VND 500,000 for committing one of the following acts:
Walking, standing, lying, sitting or performing other acts on railways, bridges, or tunnels reserved for railways (except for railway staff and functional forces on duty).
Over the fence, the fence separates the railway and the surrounding area.
Letting animals cross the railway in violation of regulations or letting animals pull the vehicle across the railway without a driver.
