Accordingly, the Council is responsible for appraising specific land price plans proposed by the Department of Agriculture and Environment, before submitting to the Provincial People's Committee for decision on land prices.
This is the basis for implementation in cases of land allocation, lease, land use purpose change, recognition of land use rights, extension of land use, adjustment of land use term, adjustment of detailed construction planning, land recovery, determination of starting price for land use rights auction, determination of land use right value when equitizing enterprises under the authority of the provincial People's Committee.
According to Clause 1, Article 17b of Decree 44/2014/ND-CP, supplemented by Decree 12/2024/ND-CP, the People's Committee has the authority to decide to establish a specific Land Valuation Council in the form of a regular operating Council or a Council operating by case in accordance with the actual situation in the locality.
Specific land valuation councils include: Chairman of the People's Committee as Chairman of the Council; Head of the same-level financial institution as Vice Chairman of the Council.
The representative of the financial institution's leadership is the standing member of the Specific Land Valuation Council.
Representatives of leaders of agencies: natural resources and environment, construction, planning and investment, taxes at the same level, leaders of People's Committees at the level directly below the land location and other members decided by the People's Committees at the competent level.
The People's Committee at the competent level can invite representatives of organizations with consulting functions to determine land prices or experts on land prices to participate as members of the Council.
The budget for the operation of the Specific Land Valuation Council and the Working Group of the Specific Land Valuation Council is guaranteed by the state budget according to the current budget decentralization; arranged in the annual budget estimate of the financial institution and used in accordance with the provisions of law.
