Bien Hoa City People's Committee has reported the results of handling administrative violations against enterprises and production facilities in the 72.08 ha area in Phuoc Tan Ward, Bien Hoa City according to inspection conclusion No. 2804/KL-UBND dated March 18, 2020 of the Provincial People's Committee.
According to the People's Committee of Bien Hoa City, the report of the People's Committee of Phuoc Tan Ward on the list of listed areas of 72.08 hectares in Tan Cang Quarter with 48 enterprises and establishments with production works. Of which, 3 enterprises and facilities have stopped operating; 1 enterprise and facility has stopped operating but leased to another company and 2 enterprises and facilities have stopped operating but are now resuming operations.
Based on the inspection conclusion No. 2804/KL-UBND dated March 18, 2020 of the Dong Nai Provincial People's Committee, out of 48 cases of land use in the 72.08 ha area, in addition to 7 cases of land use that have changed the purpose of land use with the permission of the Bien Hoa City People's Committee, the remaining 41 cases have administrative violations of land use.
Of which, before 2010, there were 4 cases; from 2010 - 2014 there were 11 cases; in 2015, there were 14 cases; in 2016, there were 4 cases; in 2017, there were 4 cases; in 2018, there were 4 cases.
Administrative violations with a total land area of 122,395 m2 (according to the administrative violation handling records).
Complete the relocation of enterprises before December 31, 2025
In addition to 7 cases of changing land use purposes, the remaining cases have been punished for administrative violations of land but have not yet taken remedial measures according to regulations (restoring the land status as before the violation).
Through reviewing the records of handling administrative violations against 48 enterprises and establishments at the 72.08 ha land plot in Phuoc Tan ward, Bien Hoa city, the city's units have compiled 76 decisions on administrative sanctions for land and construction.
In particular, in the land sector, the Department of Natural Resources and Environment (now the Department of Agriculture and Environment) has issued 17 decisions, the People's Committee of Bien Hoa City has issued 13 decisions and the People's Committee of Phuoc Tan Ward has issued 18 decisions.
Regarding the construction sector, the Department of Construction has issued 1 decision, the People's Committee of Bien Hoa City has issued 23 decisions and the People's Committee of Phuoc Tan Ward has issued 4 decisions.
Previously, on June 4, Chairman of Dong Nai Provincial People's Committee Vo Tan Duc signed a document implementing the conclusion of the Provincial Party Committee on handling a number of land-related cases in the province, and for a land plot of about 72 hectares in Phuoc Tan ward, the Provincial People's Committee requested the People's Committee of Bien Hoa City to inspect compliance with handling administrative violations of land, construction, and application of remedial measures according to regulations to force the relocation of enterprises in accordance with the direction of the Provincial Party Committee and the Provincial People's Committee and speed up the relocation progress according to plan... In case the enterprise does not comply, the People's Committee of Bien Hoa City will review administrative violation records, organize enforcement... to ensure the completion of relocation of enterprises before December 31, 2025.
According to the inspection conclusion, the forest land area, planned to be Phuoc Tan industrial cluster, in Phuoc Tan ward, Bien Hoa city, has 41 cases of land users arbitrarily converting the purpose of use from agricultural land to production and business, which is a violation of the law. In the above area, there are dozens of cases of illegal construction of large-scale industrial works and factories on land.
