Citizen L.T reflected: "I am a teacher in Vinh City (old), Nghe An Province. I am married and have 2 young children (6 years old and 8 years old), with a total family income of 17 million VND/month. My family does not have a house and is renting a room.
I am currently interested in buying social housing in accordance with state regulations. Recently, I have known that there are some social housing projects that, although the investors have not opened for sale officially, there have been cases of real estate brokers and brokers on the market. This makes me wondering about the transparency as well as the access to my social housing.
Therefore, I respectfully ask the agency to let me know: What procedures should people who want to buy social housing directly from the investor follow? How to know the list of projects, official opening time and public information from the investor? What measures do the authorities have to handle the situation of crocodiles being sold when the project is not eligible for sale? ".
Regarding this issue, the Department of Housing and Real Estate Market Management, Ministry of Construction responded as follows:
Clause 1, Article 38 of Decree No. 100/2024/ND-CP detailing a number of articles of the Housing Law on the development and management of social housing stipulates the order and procedures for selling social housing as follows:
After 30 days from the start of the project, the investor of the social housing construction investment project is responsible for providing information related to the project (project name; project investor; project construction location; contact address, registration address; project implementation progress; project scale; number of apartments (including: Number of apartments for sale; apartment area; selling price (temporary) for each type of apartment; start and end time to receive the registration and other related contents) to publicly announce on the website of the Department of Construction, People's Committee at the commune level in the locality where the project is located; post at least once at the newspaper as the mouthpiece of the local government and publicly announce at the real estate transaction of the investor (if there are people preparing to register and supervise the implementation of the project;
Before selling, the investor of a social housing construction investment project is responsible for reporting in writing the total number of apartments expected to be sold and the expected time to start receiving the documents, starting the sale so that the Department of Construction knows, checks and publicly announces on the website of the Department of Construction in the locality where the project is located within a minimum period of 30 days from the time of receiving the documents to register to buy a house in the project;
Based on information about social housing projects in the area that has been published according to the provisions of Clause 1 of this Article; households and individuals who need to submit documents to buy social housing directly to the project investor. The dossier includes an application for social housing purchase according to Form No. 01 specified in Appendix II of this Decree and documents proving the subject and conditions for enjoying social housing support policies.
Thus, people can access the website of the Department of Construction, People's Committees at the commune level where the project is located; the mouthpiece of the local government where the social housing project is located; The real estate trading floor of the investor (if any) to learn about related information.
Regarding penalties for violations of regulations on housing transaction management, Clause 1, Article 64 of Decree 16/2022/ND-CP stipulates penalties for administrative violations in construction as follows:
"Fines from VND 40,000,000 to VND 60,000,000 for one of the following acts:
a) baning, leasing, leasing-purchasing state-owned houses without proper authority, to the wrong subjects or under the prescribed conditions;
b) Selling, leasing, leasing, or purchasing social housing to the wrong subjects according to regulations;
c) Selling, leasing, leasing, or purchasing social housing that does not meet the prescribed conditions.
