According to information from the Ministry of Construction, this unit has just responded to the petition of voters in Dong Nai province (as forwarded by the Petition Committee after the 8th Session of the National Assembly) on income conditions to enjoy the policy of buying and renting social housing.
Voters in Dong Nai province recommend: The subjects eligible to buy social housing, such as policy families, police officers, soldiers, soldiers, teachers, workers, cadres, civil servants, freelance workers... must satisfy a number of conditions such as: no housing, land (not listed in any certificate of land use rights, house ownership rights) and a number of other conditions, especially the condition of monthly income under 15 million VND, stipulated in Decree 100/2024/ND-CP (with supporting documents such as labor contracts, salary tables, etc.).
Thus, for workers receiving salaries from the state budget, when the basic salary is increased from 1.8 million VND to 2.34 million VND, will the income conditions for buying this social housing be adjusted accordingly? ".
According to the Ministry of Construction, Decree No. 100/2024/ND-CP dated July 26, 2024 of the Government detailing a number of articles of the Housing Law on the development and management of social housing (effective from August 1, 2024) has stipulated income conditions for groups of beneficiaries of social housing policies.
For subjects who are low-income people in urban areas; workers and laborers working at enterprises, cooperatives, and cooperative unions inside and outside industrial parks; cadres, civil servants, and public employees as prescribed by law on cadres, civil servants, and public employees, the income conditions prescribed in Clause 1, Article 30 shall apply as follows:
In case the petitioner is a single person, with actual monthly income, the monthly income must not exceed 15 million VND calculated according to the salary table confirmed by the agency, unit, or enterprise where the subject works.
In case the plaintiff is married according to the provisions of law, the plaintiff and his/her wife (husband) with a total monthly income shall receive no more than 30 million VND in salary according to the salary table as confirmed by the agency, unit, or enterprise where the subject works.
For officers, professional soldiers, non-commissioned officers of the People's Armed Forces, police workers, civil servants, workers and defense officials currently serving in the army; people working in cryptography, people working in other cryptographic organizations receiving salaries from the state budget currently working, the income conditions according to the provisions of Article 67 of Decree No. 100/2024/ND-CP shall apply.
In case the plaintiff is a single person, the actual monthly income received must not exceed the total income of an officer with the rank of Colonel (including basic salary and allowances according to regulations) confirmed by the agency or unit where he/she works or manages.
In case the single parent and his/her husband (husband) are both subjects specified in Clause 7, Article 76 of the 2023 Housing Law, have a total actual monthly income not exceeding 2.0 times the total income of an officer with the rank of Colonel (including basic salary and allowances according to regulations) confirmed by the agency or unit where they work or manage.
The wife (husband) of a plaintiff who is not subject to the provisions of Clause 7, Article 76 of the 2023 Housing Law shall have a total actual monthly income not exceeding 1.5 times the total income of an officer with the rank of Colonel (including basic salary and allowances according to regulations) confirmed by the agency, unit or enterprise where the subject works.
In case the petitioner's wife (husband) does not have a labor contract, the People's Committee at the commune level will confirm the income conditions.
Thus, for employees receiving salaries from the state budget and workers, the income condition to enjoy the policy of buying and renting social housing is the income level calculated according to wages and salaries confirmed by the agency, unit, or enterprise where the subject works, not dependent on the adjustment of the basic salary as proposed by Dong Nai voters.
