On the morning of July 8, the National Assembly Standing Committee gave opinions on the draft Law amending and supplementing a number of articles of the Architecture Law.
At the meeting, Minister of Construction Tran Hong Minh said that the draft law amends and supplements regulations to ensure the unity and synchronization of the legal system; delineate responsibilities and authority in accordance with the 2-level local government organization model.
At the same time, this amendment also aims to decentralize, decentralize, simplify processes and procedures, improve the investment and business environment, as well as overcome problems and inadequacies arising in reality.
Regarding the regulations on architectural management, this amendment also supplemented regulations suitable for the organization of local government at 2 levels, in accordance with legal regulations on urban and rural planning, and continued to simplify the issuance procedures.
Chairman of the Committee for Science, Technology and Environment Nguyen Thanh Hai said that most of the regulations in the draft law are feasible and consistent with the direction of reforming legislative work.
However, it is necessary to consider some contents, specifically the complete decentralization for commune-level People's Committees to issue Architecture Management Regulations right now will face difficulties due to the qualifications and capacity of grassroots officials.
This regulation needs to be considered, researched, and revised in the direction that communes organize the establishment, higher-level specialized agencies have opinions for appraisal, or provincial-level People's Committees must issue a model regulation framework for uniform application" - Chairman of the Committee for Science, Technology and Environment emphasized.

Ms. Nguyen Thanh Hai also proposed to study and revise the draft law in the direction of increasing flexibility, allowing localities to proactively determine the scope of establishing Architecture Management Regulations. It is not mandatory to establish Regulations across all administrative boundaries but focus on specialized areas, new urban areas, and central areas.
In particular, it is necessary to have regulations to strictly control urban design for large-scale real estate projects invested by private individuals and areas along lakes and rivers to protect the general landscape.
Speaking at the session, Vice Chairman of the National Assembly Nguyen Khac Dinh also paid attention to the content of decentralizing authority to the commune level.
According to Mr. Nguyen Khac Dinh, in fact, many communes, wards, and special zones can do it immediately. However, there are also places that are still very weak, the work is overloaded, and decentralization cannot be done immediately.
Currently, there are about 705 communes that are still very small, in the rearrangement phase, if decentralized immediately, it cannot be implemented. It is proposed to follow the spirit of the Law on Organization of Local Government and the Law on Organization of the Government.
Through that, superiors assign it to subordinates, if subordinates cannot do it, superiors collect it back" - Vice Chairman of the National Assembly Nguyen Khac Dinh said and added that in case subordinates see that they can do it, they should request superiors to assign it with implementation conditions attached.
Vice Chairman of the National Assembly Nguyen Khac Dinh also said that it should not be assigned directly to communes immediately, but in the law it should be assigned to provinces. Depending on local conditions and circumstances and commune-level capacity, the province decides to decentralize according to management requirements. Only then will there be someone responsible.
