Citizens sent questions to the Ministry of Agriculture and Environment asking: Currently, they are completing procedures to change land use purposes and are using form 01 according to Decree No. 151 of 2025 of the Government supplemented by Decree 226 of 2025 of the Government.
In the person requesting, citizens must record their own name and citizen identification card, date of issuance, and issuance unit. When submitting documents at the one-stop department, civil servants are required to fully record the names of those on the certificate, so is that true or false?
Responding to this content, the Ministry of Agriculture and Environment said that according to the provisions of Form No. 01 issued with Decree No. 151/2025/ND-CP, a legal representative according to the provisions of the law on civil matters does not need to fully record the names of other people on the certificate. In case there is no legal representative as prescribed by the law on civil matters, all names on the Certificate must be declared.
Clause 5 and Clause 6, Article 32 of Circular No. 10/2024/TT-BTNMT dated July 31, 2024 stipulates information on land users and owners of assets attached to land appearing on the Certificate of land use rights and ownership of assets attached to land in cases where a group of land users and members share land use rights.
The Ministry recommends that citizens study and comply with the provisions of law, if there are any difficulties or problems, citizens must have documents with records and documents to send to competent authorities on land management for settlement according to their authority.
