On October 30, continuing the 8th Session, the National Assembly discussed in Groups the draft Law amending and supplementing a number of articles of the Law on Planning, the Law on Investment, the Law on Investment under the public-private partnership model and the Law on Bidding.
At the discussion session, referring to the Investment Law, Permanent Deputy Prime Minister Nguyen Hoa Binh said that the difficult and complicated issues have been basically selected by the Government for amendment.
In particular, there are regulations to terminate activities for projects that are behind schedule, projects that have not been implemented for many years, causing waste of land in order to free up resources for socio-economic development.
The Permanent Deputy Prime Minister affirmed that localities are in dire need of this regulation, because in reality there are cases where projects are obtained through connections, but the capacity to execute them is not there, and then transferred, causing huge waste.
Discussing in groups, delegate Vu Dai Thang (National Assembly Delegation of Quang Binh province) raised a number of difficulties in implementing the Investment Law, the Law on Investment under the public-private partnership model and the Law on Bidding.
These are difficulties in site clearance, slow disbursement, delays in investment procedures, waiting between planning at one level and planning at another, delays in converting land use and forest use purposes.
Speaking at the meeting, Minister of Planning and Investment Nguyen Chi Dung emphasized the agreement of National Assembly deputies with the Central Government's policy, the spirit of the National Assembly and the Government on innovation in law-making thinking. This is a very new and breakthrough idea.
That is, law making must both serve management and create development, promote creativity, expand space, and liberate resources for national development.
Mr. Nguyen Chi Dung emphasized the spirit of "if you can't do it, ban it" and the "ask - give" mechanism, avoiding the situation of "your rights, my rights".
Regulations in general laws, then specialized laws, but in the end also create procedures and "request-grant mechanisms". That does not keep up with development, so this time it must be overcome.
In addition, Minister Nguyen Chi Dung also affirmed the shift from pre-inspection to post-inspection; more thorough decentralization and delegation of authority; more thorough cutting of administrative procedures, making them shorter, reducing time and costs, and not losing investors' opportunities.
Also at the group discussion session, National Assembly Chairman Tran Thanh Man emphasized that amending and supplementing specific provisions of the four laws is necessary.
The National Assembly Chairman also noted that when considering and deciding on this bill, the National Assembly must consider carefully. The amendment of the law must ensure favorable conditions for investors, including foreign investors, to come to Vietnam.
Regarding the Investment Law and the PPP Law, the recent implementation shows that in order to attract foreign investors, some provisions must be amended. The Bidding Law must also be amended to ensure the selection of capable contractors who can construct quality, national-scale projects.
Based on the Government's submission, the National Assembly Chairman requested that National Assembly deputies carefully consider it before pressing the approval button.
