Resolution 170/2024/QH15 of the National Assembly and Decree 76/2025/ND-CP of the Government have removed a series of "shelved" projects. However, in reality, according to data reported by the Ho Chi Minh City Real Estate Association (HoREA), there are currently 1,533 real estate projects facing difficulties nationwide.
Sharing with Lao Dong reporter, Mr. Le Hoang Chau - Chairman of HoREA - said that it is necessary to continue to synchronize and unify legal regulations so that all of these projects are treated equally.
According to Mr. Le Hoang Chau, for the first time the National Assembly has issued "specific mechanisms and policies" to serve as a basis for handling and removing difficulties and obstacles for 64 specific projects in the conclusions of inspections, examinations and judgments in Ho Chi Minh City, Da Nang City and Khanh Hoa Province.
Thereby, creating conditions for the final handling of 49 projects in Da Nang city (accounting for 77% of the total number of projects) and 11 projects in Khanh Hoa province (accounting for 17% of the total number of projects) and 4 projects in Ho Chi Minh City (accounting for 6%).
This has created conditions for restarting 64 projects that have been "shelved" for decades, which will have a positive impact on the socio-economic and investment and business environment of the locality.
This expert added that not only Resolution 170/2024/QH15 but also Decree 76/2025/ND-CP has allowed that after reviewing, meeting the conditions, and fully fulfilling financial obligations to the State, investors can restart these 64 "covered" projects.
At the same time, continue to carry out investment procedures for construction and business, both ensuring the legitimate and legal rights and interests of investors and secondary investors, customers, and home buyers, both overcoming the situation of "waste" of land and ensuring the state budget "collects correctly and fully", not causing loss or loss.
According to Mr. Chau, not only 64 projects in Da Nang, Khanh Hoa, Ho Chi Minh City but also many other localities have similar projects that need to be resolved.
To remove difficulties for 1,533 real estate projects nationwide, Mr. Le Hoang Chau suggested that the Ministry of Agriculture and Environment consider proposing that the Prime Minister submit to the National Assembly to consider expanding the scope of regulation of Resolution No. 170/2024/QH15.
Accordingly, Resolution No. 170/2024/QH15 is allowed to apply similarly to all similar projects in all provinces and centrally run cities to remove difficulties for many projects out of a total of 1,533 projects that are facing difficulties.
Propose that the Ministry of Agriculture and Environment consider proposing to the Prime Minister to abolish the regulation "The State does not refund the difference" in Points b, Clause 6, Article 5, Point b, Clause 4, Article 6, Point b, Clause 3, Article 7 and Point c, Clause 2, Article 8 of Decree No. 76/2025/ND-CP.
Because, according to Mr. Chau, these points may not be consistent with the provisions of Clause 3, Article 51 of the 2013 Constitution, not in accordance with the provisions of Article 163 of the 2015 Civil Code and not in accordance with Resolution No. 170/2024/QH15 of the National Assembly.
At the same time, it is proposed to supplement the mechanism of "The State refunds the difference" to investors at points b, clause 6, Article 5, Point b, Clause 4, Article 6, Point b, Clause 3, Article 7 and Point c, Clause 2, Article 8 of Decree No. 76/2025/ND-CP to ensure the consistency and unity of the legal system and reasonable understanding.
