The Ministry of Construction drafted a Decree amending and supplementing a number of articles of Decree No. 100/2024/ND-CP dated July 26, 2024 of the Government detailing a number of articles of the Housing Law on the development and management of social housing.
One of the notable proposals is that the Ministry of Construction proposes to amend and supplement Clause 1 and Clause 2, Article 30 on income conditions. In which, the draft proposes:
In case the subject specified in Clause 5, Article 76 of the Housing Law does not have a Labor Contract, it must ensure the income conditions as prescribed in Clause 1 of this Article and be confirmed by the police agency at the commune level where the person is residing/temporarily residing or currently residing.
Within 07 days from the date of receipt of the confirmation request, the police agency at the commune level where the subject is residing or residing at the time the subject requests confirmation shall base on the information of the population database to confirm the income conditions.
Explaining the regulations on proposing to change the agency to confirm income conditions for buying and renting social housing for low-income people in urban areas without labor contracts as prescribed in Clause 2, Article 30 of Decree No. 100/2024/ND-CP of the Ministry of Construction as follows:
The Ministry of Construction has received many recommendations and feedback from some localities such as the People's Committee of Thanh Hoa province, the Department of Construction of Hanoi, Da Nang, Can Tho, Quang Ninh..., organizations and individuals regarding some problems and difficulties in confirming income conditions for low-income people in urban areas without labor contracts because the People's Committees at the commune level do not have information and data on population as a basis for confirmation.
To remove the above difficulties and obstacles, in document No. 120/TBVPCP dated March 18, 2025 of the Government Office, announcing the Prime Minister's conclusion at the National Online Conference on removing difficulties and obstacles, promoting the development of social housing assigned: The Ministry of Public Security innovates the population database, adds information on the assessment of people eligible to buy social housing based on the database to use in the confirmation of buyers, renters, and renters of social housing, minimizes procedures.
Therefore, the Ministry of Construction proposes that in cases where low-income people in urban areas do not have labor contracts, they must ensure income conditions according to regulations and be confirmed by the police agency at the commune level where they are permanent/temporarily residing or are currently residing.
At the same time, the Ministry of Construction will amend and supplement documents proving and confirming the conditions to ensure consistency with the above regulations.
