Ho Chi Minh City People's Committee has just issued Decision No. 4588/QD-UBND on applying legal regulations at the time of approval of compensation, support, and resettlement plans to handle the remaining area of projects in the city.
According to the list released by the Ho Chi Minh City People's Committee, there are 25 urgent infrastructure projects and works that apply this mechanism. Among them, there are many large-scale transportation projects and power grid projects. For example, the Ho Chi Minh Road Project (Chon Thanh - Duc Hoa section), the Duc Hoa - Chon Thanh 500kV power line project, the Bau Bang industrial park infrastructure construction and business investment project, the Vietnam - Singapore III Industrial Park project in Tan Uyen, the component project 6 of Ring Road 3 HCMC section passing through Thuan An ward...


For projects in the above list, the Ho Chi Minh City People's Committee allows the application of legal regulations on compensation, support, and resettlement at the time of approval of the previous compensation, support, and resettlement plan of each project to continue to prepare, appraise and approve compensation, support, and resettlement plans for the remaining area of each project under the cases specified in point b, clause 13, Article 3 of Resolution No. 254/2025/QH15 and clause 2, Article 19 of Decree No. 49/2026/ND-CP.
People's Committees of communes, wards, and special zones are responsible for reviewing and identifying each project under the cases specified in point b, clause 13, Article 3 of Resolution No. 254/2025/QH15 and clause 2, Article 19 of Decree No. 49/2026/ND-CP before organizing the preparation, appraisal, and approval of compensation, support, and resettlement plans.
The Ho Chi Minh City People's Committee also requested that the application of legal regulations according to the above decision does not change the scope of land recovery, the beneficiaries of compensation, support, and resettlement have been decided by competent authorities; it is only applied to the preparation and approval of compensation, support, and resettlement plans for the remaining area of the project.
The core objective is to definitively resolve the area that has not been cleared before Resolution No. 254/2025/QH15 takes effect. At the same time, ensure that no additional budget obligations are incurred outside regulations.
For effective implementation, the Ho Chi Minh City People's Committee assigns the People's Committees of communes, wards, and special zones to be responsible for thoroughly reviewing the legal documents of each project. Localities must accurately identify the subjects and scope of application before organizing the preparation and approval of the plan.
The Department of Agriculture and Environment is responsible for professional guidance, inspection and supervision, and promptly reporting and proposing handling measures to the City People's Committee if it is found that the project does not meet the application conditions.
